Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2012-750, Gastineau Channel

    Expiration date: 10/28/2015

    The applicant, Roscoe Bicknell IV’s, stated purpose is to provide a centrally-located facility for disposal of unclassified fill materials, (stumps, overburden, frost-susceptible soils, etc.), in Juneau, Alaska. PROPOSED WORK: The applicant is proposing to use an existing pond, commonly referred to as “Honsinger Pond”, as a disposal site for unclassified fill material. The work would include the placement of 953,000 cubic yards (cy) of fill material into 27 acres of lacustrine Waters of the United States (U.S.) for disposal purposes. The material would consist of unclassified land clearing waste such as stumps, organic overburden, and frost-susceptible soils. All work would be performed in accordance with the enclosed plan,5 (sheets 1-6), dated April 27, 2015.   • POA-2005-1976, Portage Cove

    Expiration date: 10/24/2015

    The applicant, Haines Borough's, stated purpose is to construct harbor and wave protection facilities to increase capacity while providing safe vessel navigation, moorage, launching, loading, staging and parking improvements, and provide clearance for proposed boat launch, drive down float, and additional vessel moorage. All work would be performed in accordance with the enclosed plan (sheets 1 - 20), dated July 30 , 2015.   • POA-2000-641-M4, Anchorage Bay

    Expiration date: 10/23/2015

    The applicant, Mr. Nathan Hill, Lake and Peninsula Borough's, stated purpose is to construct a public dock facility in Chignik. PROPOSED WORK: The applicant proposes to discharge 49,000 cubic yards (cy) of fill material, stockpiled gravel and riprap, into 1.6 acre of Anchorage Bay to faciliate construction of a 315 foot long sheetpile dock and associated facililties, inlcuding fender systems, mooring and breasting dolphins, catwalk, and staging and access areas. As provided by the applicant, proposesd work includes: • Remove and salvage the existing Class B armor rock along the existing fill area, where the proposed dock would be constructed; • Construct a bulkhead dock structure by driving 935 sheet piles, backfilling with the existing material stockpiled on-site. Material would be stabilized using vibracompaction; • Reconfiguration of salvaged Class B rock, addition of new Class A rock at Sections A, B and C, (refer to sheet 8 of 9). Section A includes placement of 800 cy of Class B rock and 1400 cy of Class A rock along two areas with a combined length of 230-ft and 40-50-ft width. Section B includes placement of 4900 cy of Class A rock within an area 520-ft in length and 40 -50-ft in width. Section C includes placement of 1800 cy of Class A rock within an area 470-ft in length by 15-40-ft in width. At Sections B and C, additional Class B rock would be placed; however, this activity would occur above the high tide line, thus outside our regulatory jurisdiction; • Install breasting dophin, mooring dolphin, linked with a catwalk. Each dophin would be supported by four 30-inch diameter steel piles, (install eight 30-inch steel piles); • Install five fender systems along the dock face and one fender system on the breasting dolphin, each with two steel pin piles, (install twelve 30-inch diameter steel piles); • All 30-inch diameter steel piles would be driven with a vibratory hammer, as practicable; an impact hammer would only be utilized if necessary. • The applicant is requesting Special Condition 2C be removed from the original permit and from this modification, hould the work be authorized. Special Condition 2C prohibits in-water work between July 30 and September 10, to protect returning salmon (adults). The applicant has indicated that all pile driving would occur during daytime hours to ensure a minimum 12 hour period of time (overnight) when fish may pass through the area, minimzing disturbance. All work would be performed in accordance with the enclosed plan (sheets 1-9), dated July 2015, and August, 2015. Comments on the described work, with the reference number, should reach this office no later than the expiration date of this Public Notice to become part of the record and be considered in the decision.   • POA-2015-354, McKenzie Inlet

    Expiration date: 10/22/2015

    The applicant, Sealaska Timber Corporation's, stated purpose is to construct a log sort yard, campsite, and service float, including the installation of standing log booms and anchor bouys for building log rafts and ship moorage. PROPOSED WORK: The applicant requests authorization for the following work in waters of the United States: 1. Discharge 305 cubic yards of stack rock and shot rock fill material into 0.016 acres below the High Tide Line (approximate elevation +19.4 feet above the 0.0 foot contour) to construct a 12 feet wide by 50 feet long approach. 2. Construct below the Mean High Water mark, (MHW), (approximate elevation +14.4 feet above the 0.0 foot contour), one 5 feet wide by 70 feet long timber ramp, connected to one 30 feet wide by 30 feet long log service float, secured to the seafloor by four 1-ton anchors. 3. Excavate by drilling and blasting 1,320 cubic yards from 0.15 acres below the MHW to construct a 122 feet long by 45 feet wide Log Transfer Facility drive-down ramp, including the installation of two 18-inch steel skids below the MHW. 4. Discharge 13,000 cubic yards of organic overburden and shot rock fill material into 0.02 acres of wetlands to construct a 4 acre sort yard. 5. Install below the MHW, one 2,600 feet long standing log booms anchored with ten 6-ton concrete anchors with bouys. 6. Install below the MHW one 2,000 feet long standing log booms anchored with seven 6-ton concrete anchors with bouys. 7. Install below the MHW three 800 feet long standing log booms anchored with nine 6-ton concrete anchors with bouys. 8. Install below the MHW two 6-ton concrete anchors with bouys for ship moorage. All work would be performed in accordance with the enclosed plan sheets 1 - 4, dated July 20, 2015, and sheets 1 - 2, dated September 9, 2015.   • POA-2012-303, Resurrection River

    Expiration date: 10/21/2015

    The applicant, The National Park Service/ Kenai Fjords National Park, attn: Rebecca Lassell or Sharon Kim's, stated purpose is to maintain summer vehicular access to the Exit Glacier visitor use area in an area subject to annual seasonal flooding of the road from milepost seven to eight which has resulted in temporary road closures, public safety concerns, as well as road deterioration. PROPOSED WORK: PROPOSED WORK: The applicant is proposing to discharge 26,000 cubic yards (cy) of aggregate material and 5,000 cy of of rip rap into 2.46 acres of wetlands to raise the existing road five feet, installation of four box culverts (6 feet wide by 5 feet tall), and the placement of rip rap on the south side of the road at a 2:1 slope. The work would occur over a distance of 5,400 linear feet of the current road alignment. All work would be performed in accordance with the enclosed plan, (sheets 1-2), dated August 17, 2015.
