POA-2014-109, Zimovia Strait

Big Bites Fishing stated purpose is to construct a causeway, floatplane dock, and ramp and dredge a basin to obtain sufficient water levels to moor boats and aircraft on the water for a commercial fishing operation. Placement of 11,348 cubic yards of shot rock and 3,500 cubic yards of dredged material within a 0.93-acre area below the high tide line of Zimovia Strait to construct a causeway. The causeway would vary in length from 508-feet to 604-feet. The shore end of the causeway would be 26-foot wide at the base and beginning at 400 feet from shore the base would be 94-foot wide. The causeway would be used to access a 5-foot by 70-foot aluminum ramp, a 10-foot by 70-foot concrete float, and a 10-foot by 50-foot concrete float supported by (8) 12-inch diameter steel piles. The work would also include a 0.31-acre dredge basin to allow for boats and float planes to float at all tide levels. The current depth is at the +3 tide level and the proposed dredging of 3,500 cubic yards of sand/gravel/clay material would provide a -6 tide level depth for the basin. The material would be dredged with an excavator. The core at the end of the causeway would be used to deposit the dredged material. On 21 April 2014, the USEPA and the Corps of Engineers (Corps) are publishing a Notice of Availability and Public Comment to announce the availability of an interpretive rule regarding the applicability of the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA) for discharges of dredged and/or fill material associated with certain agricultural conservation practices based on the Natural Resources Conservation Service (NRCS) conservation practice standards that are designed and implemented to protect and enhance water quality. The interpretive rule was effective on April 03, 2014.

On 21 April 2014, the USEPA and the Corps of Engineers (Corps) are publishing for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act.

POA-1968-33-M2,Gastineau Channel

City of Juneau stated purpose is to allow for all tide moorage and improved access and navigability. To dredge 2,600 cubic yards of native material from a 15,322 square foot area below the mean high water mark (MHWM, 15.4’) of Gastineau Channel to -22 feet mean lower low water (MLLW), box cut with ½:1 side slopes to minimize overall dredge quantities in navigable waters of the United States. Dredging would be conducted with a clam shell bucket or conventional hydraulic excavator from an anchored barge. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated February 2014. The contract documents mandate that the contractor provide a non-wetland, non-jurisdictional uplands dredge disposal site. Primary dewatering would be onsite within the harbor basin prior to hauling to the site in a water tight haul truck. Construction activities would occur between September 2014 and May 2015. POA-1980-468-M13, Resurrection Bay

Mr. Jim Hunt's stated purpose is to improve existing facilities by addressing wave exposure deficiencies and to provide new facilities to accommodate the growing industrial and moorage needs of the Seward Marine Industrial Center (SMIC). Proposed Work: The applicant would dredge a total of 206,000 cubic yards (CY) of material from an 11.6 acre area below the mean high water mark (MHWM, 9.6 feet elevation) of Resurrection Bay to a depth of -26 feet below mean low low water (MLLW, 0 feet elevation) and discharge 206,000 CY of the dredged material into a 28 acre deepwater disposal area, located below the high tide line (HTL, 13.8 feet elevation) of Resurrection Bay. In addition, a total of 143,350 CY of material would be discharged into 5.8 acres below the HTL of Resurrection Bay. Please contact Katherine A.
