Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2017-446

    Expiration date: 10/30/2017

    *Applicants Name - Andrew Beaver *Purpose: The applicant’s stated purpose is to provide the village of Kwigillingok with a three-cell sewage lagoon compliant with State of Alaska regulations and meeting Alaska Pollutant Discharge Elimination System (APDES) requirements and standards. The existing single-cell sewage lagoon does not meet APDES standards or have the capacity to serve additional users. The sewage lagoon discharge area also lacks fencing. ATV and snow machines with haul trailers have difficulty turning around because the existing boardwalk dead ends at the lagoon. Fencing the two sewage lagoon cells and creating a turnaround boardwalk is needed for worker and public safety and to protect the environment from accidental sewage spills. *Location: The project site is located within Kwigillingok, Alaska, at Latitude 59.86252º N., Longitude 163.169417º W. *Proposed Work: The proposed project would include the construction of a new primary lagoon cell (cell #1), rehabilitation of the existing lagoon cell (cell #2), develop a polishing cell (cell #3), upgrade an existing boardwalk, build new boardwalk, develop a new material borrow site, and construct a new fence. The proposed project would fill approximately 2.56 acres of palustrine wetlands to construct a new primary lagoon cell (cell #1) and a new material borrow site.   • POA-2000-152

    Expiration date: 10/27/2017

    Mr. John Barnett (Alaska Department of Transportation & Public Facilities) stated the purpose is to improve surface transportation between Revillagigedo Island and Gravina Island. The project site is located within Sections 16, 21, and 22, T. 75 S., R. 90 E., Copper River Meridian; USGS Quad Map Ketchikan B-6; Latitude 55.3607º N., Longitude 131.7390º W.; near Ketchikan, Alaska. PROPOSED WORK: This authorization would permit the Seley Road component of the Gravina Access Project. The other authorizations are being reviewed under separate actions and consist of upgrades to the Revillagigedo Island Ferry Berth (POA-2017-466), Gravina Island Ferry Berth (POA-2017-467), Gravina Island Layup Dock replacement (POA-2017-467), and Gravina Island Heavy Freight Mooring Facility (POA-2017-468). Reconstruction of Seley Road would begin at Lewis Reef Road to approximately the north end of the Airport Reserve and widen the road to 36 feet. Additionally, road construction would consist of new abutments for the Airport Creek Bridge and the placement of fish passage culverts in all fish bearing streams. Up to 21,770 cubic yards of material would be discharged into 6.1 acres of wetlands for the road construction and 0.2-acre of stream impacts below the Ordinary High Water Mark (OHW) to construct a bridge and three culverts to accommodate fish passage. Temporary impacts would occur during the construction phase at the Airport Creek Bridge and would consist of up to 4,667 cubic yards of material discharged into 0.10-acre.     ***PUBLIC NOTICE RESPONSE PERIOD EXTENDED*** On September 18, 2017, the Alaska District Corps of Engineers published a Public Notice for Department of the Army (DA) permit number POA-2017-336, China Poot Bay for a DA permit application from Ms. Gail Fisher (China Bay, LLC), construct a floating dock, an aluminum gangway, and a timber boardwalk in China Poot Bay. The project site is located within Section 15, T. 7 S., R. 12 W., Seward Meridian; USGS Quad Map Seldovia C-4; Latitude 59.5755º N., Longitude 151.3146º W.; China Poot Bay; Kenai Peninsula Borough tax parcel 193-270-03; 4.4 miles southeast of Homer, Alaska. The comment period for this application was scheduled to end on October 3, 2017. The comment period has been extended to November 2, 2017.     ***PUBLIC NOTICE REVISION*** Hilcorp Alaska, LLC stated the purpose is to construct a self-contained offshore drilling and production facility located in the Beaufort Sea Outer Continental Shelf (OCS). The project site is located within two federal leases (OCS-Y1650 and OCS-Y1585), in Foggy Island Bay within the Beaufort Sea, northeast of the Prudhoe Bay Unit, and east of the Duck Island Unit. The Liberty Development Production Island (LDPI) would be located approximately five miles north of the Kadleroshilik River in approximately 19 feet of water at Latitude 70.2746º N., Longitude 147.5863º W. The original Public Notice comment period closed on September 20, 2017. The Public Notice comment period has been extended to November 18, 2017.   • POA-2015-25, Colville River

    ***PUBLIC NOTICE REVISION 2*** On September 1, 2017, the Alaska District Corps of Engineers published a Public Notice for Department of the Army (DA) permit number POA-2015-25, Colville River for a DA permit application from Armstrong Energy, LLC, to discharge 2,756,520 cubic yards (cy) of clean fill material into 271.6 acres of waters of the United States (U.S.) including wetlands to construct the Project. The Project also includes temporary discharges to 5.8 acres of jurisdictional waters of the U.S., (Harrison Bay of the Beaufort Sea), for screeding activities in front of the existing Oliktok Dock and trenching for power and fiber optic cables at pipeline road crossings. The Project would be located 6.5 miles to the northeast of the village of Nuiqusut, in the North Slope Borough (NSB) in the Pikka Unit between Kuparuk and the Colville River Unit development (Alpine). The Project would extend west from existing Kuparuk infrastructure to the East Channel of the Colville River. The original Public Notice comment period closed October 15, 2017. The Public Notice comment period has been extended to November 14, 2017. The scoping period for the Nanushuk EIS has been extended to November 14, 2017.
