Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

    Mr. Roger Sampson stated the purpose is to install a rock pad with a rip rap bulkhead that would skirt the water’s edge of the property to allow the space and level ground to construct a home, garage, and space for parking while meeting the Alaska Department of Transportation (ADOT) residential set back requirement. The project site is located within Section 4, T. 59 S., R. 79 E. Copper River Meridian; USGS Quad Map Petersburg D-3; Latitude 56.7919º N., Longitude 132.9805º W.; Olson/MacDonald Subdivision, Lot 2A. To get to the site: beginning from Petersburg, drive south on Mitkof Highway approximately two miles and on the west is the location of the property (208 Mitkof Highway, Near Petersburg, Alaska). The applicant proposes to fill an area below the high tide line (HTL) but above mean high water (MHW) that would be 100 feet wide by 25 feet long by 12 feet high (2,500 square feet or 0.057-acre) with approximately 400 cubic yards of rip rap and 800 cubic yards of shot rock. The source of the fill material would be from Reid Brothers Construction's quarry at 339 Mitkof Highway. The excess material from the work site would be hauled and dumped at the Petersburg Borough Mud Dump. The equipment used for the project would be 10 yard dump trucks to haul in the fill material and to haul out any backfill, and the machine used for the excavation would primarily be a Kobelco 140 excavator, and a Komatsu 200 could be used for some aspects of the work. All work would be performed in accordance with the enclosed plan (sheets 1-5, dated January 2018). Work would occur in March or April of 2018 and would last approximately 5-8 days.     Pebble Limited Partnership's stated purpose is to discharge fill material into and perform work within waters of the United States. The project site is located in Southwest Alaska near Iliamna Lake, primarily within the Lake and Peninsula Borough with a portion of the supporting infrastructure in the Kenai Peninsula Borough. The project consists of four primary project elements: a mine site, a port at Amakdedori, transportation corridor, and natural gas pipeline.
