Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2018-00123, Bonanza Channel/ Safety Sound

    Expiration date: 8/31/2020

    Mr. Beau Epstein with IPOP, L.L.C, states the project purpose is to economically produce gold from IPOP’s mining claims on the Bonanza Channel/ Safety Sound area near Nome, Alaska. The applicant proposes to discharge 4,973,992 cubic yards of material into 172.7 acres of waters of the U.S. (WOTUS) (over 5 years) to construct and maintain an access channel, dredge disposal areas, mining channel, and a mine camp and staging area in approximately 4 acres of uplands. The mine site would be accessed by a dredged channel (dimensions 2,150-4,500 feet (‘)-long x 85’ wide by 10’ deep, 4.2 acres in size) that would be maintained and/or re-established annually. Dredged material would be placed into one of four dredge disposal areas (64.3 acres, total). The 5 year mine plan calls for mining 21.7 acres per year from a continuous trench (dimensions per year: 1240’ long x 400’ wide x 31 feet deep). The active mining area would be no more than 15 acres at any one time. The project site is located between Latitude 64.5044 N., Longitude 164. 6169 W. on the west limit, and Latitude 64.5694 N., Longitude 164.2671 W. on the east limit, approximately 25 miles east of Nome, Alaska.   • POA-2005-01171, Fish Creek

    Expiration date: 8/14/2020

    The City and Borough of Juneau, Eaglecrest Ski Area, 5651 North Douglas Highway, Juneau, AK 99801, state that the project purpose is to perform trail improvements to the Lower Loop Nordic Trail. Work being proposed includes, to discharge clean shot rock fill material into waters of the U.S. consisting of Palustrine emergent and forested wetlands to construct improvements to the Lower Loop Nordic Ski Trail.   • POA-2015-00197-M1, Portage Cove

    Expiration date: 8/27/2020

    Mr. Greg Schlachter, with Front Street LLC, states that the project purpose is to expand the current pad for marine vessel storage and maintenance. Work being proposed includes to discharge 14,295 cubic yard of 12-inch minus material and 400 cubic yards of coarse shot rock into 0.72 acres of intertidal area below the High Tide Line (HTL) 21.2 feet above the Mean Lower Low Water (MLLW) 0.00-foot contour of Portage Cove, a navigable water of the U.S., in order to expand existing vessel storage/maintenance operations. All work would be performed in accordance with the enclosed plan (sheets 1-5), dated July 23, 2020.     Mr. Larry Pederson with Bering Straits Native Corporation, states the project purpose is to improve shipping infrastructure for rock and gravel export from Nome to other villages on the Seward Peninsula. The applicant proposes to discharge up to 296,296 cubic yards of gravel from Dredges 5 and 6, into 23 acres of wetlands (Dimensions 1000 linear feet (‘) long x 1000' wide x 4’ to 8’ high). All work would be performed in accordance with the enclosed plan (sheets 1-4), dated July 13, 2020.   • POA-2017-00528, Otter Creek

    Expiration date: 8/12/2020

    Mr. Doug Baker, states the project purpose is to produce commercial quantities of precious metals from alluvial deposits on patented land. The applicant proposes to recover precious metals from alluvial deposits in previously mined ground and in unmined wetlands on patented mining claims owned by Aurquest Alaska, Incorporated. The project is located along Otter Creek near Nome, Alaska. Proposed work includes the phased placer mining of approximately 17 acres of historically mined uplands (mined 1903-1911), and the mechanized land clearing of approximately 60 acres of Palustrine Emergent Persistent Saturated/Scrub-Shrub Broad-Leaved Deciduous Saturated wetlands (PEM1/SS1B). Additional work includes the construction of two settling ponds (sized 80 feet wide x 80 feet long x 1.5 feet deep and 450 feet long x 150 feet wide x 8 feet deep). Plans also include the construction of an approximately 2,000 linear feet x 11 feet wide x 2 feet deep with a floodplain of approximately 32 feet wide permanent stream relocation of Otter Creek. The stream relocation will act to stabilize the stream and to reconnect it to the natural floodplain which was ditched during the1904 gold rush. The project site is located within Section 21 T. 11 S., R. 33 W., Kateel Meridian; USGS Quad Map Nome C-1; Latitude 64.5205º N., Longitude165.2915º W.; located along Beam Road, approximately 3.5 miles from Nome, Alaska.
