Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

    Expiration date: 1/27/2022

    Alaska Department of Transportation and Public Facilities states the purpose is to rehabilitate and replace existing damaged boardwalks, repair and widen the existing Barge Landing Access Road from the school area to Adam’s Landing on the Selwaik River, and construct a barge staging area. Discharge 13,095 cubic yards of gravel into 1.63-acres of wetlands to widen an existing barge access road to approximately 40 feet toe-to-toe, construct a barge landing storage pad, restore the eroded streambank at the Rainbow Bridge, and upgrade (widen) numerous boardwalks in the community. The stream restoration work would include the discharge of 65 cubic yards of fill below the Ordinary High Water Mark of the Selawik River. The project site is located in Sections 17 and 20, T. 14 N., R. 6 W., Kateel Meridian; Latitude 66.6092º N., Longitude 160.0163º W.; Selawik, Alaska.     Expiration date: 1/21/2022

    Michael Heumann – Chilkat Vistas LLC states the purpose is to subdivide a large tract of property in order to provide small residential lots to help meet the current demand for affordable housing in Juneau, Alaska. The applicant is proposing to develop portions of their property consisting of the connection of Hooter Lane and Hillcrest Avenue, the development of 13 single family lots, and one larger multi-family lot. The proposed development would result in the placement of fill into 0.31-acres of wetlands.     Expiration date: 1/19/2022

    Mr. Gerard Farkas, 4817 Wesleyan Drive, Anchorage, Alaska 99508, states the purpose is to provide access to private property through public easements. Discharge up to 4,300 cubic yards (CY) of pit run gravel fill material into 1 acre of wetlands in order to construct a 2,758-foot long by 23-foot wide (toe-to-toe) road. The road would travel through both wetlands and uplands. Of the road’s total length, 1,896 feet would be within wetlands. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated December 10, 2021. The project site is located at Latitude 61.5384º N., Longitude 149.9644º W.; off Hour Road, in Big Lake, Alaska.     Hilcorp, Alaska LLC; Dan Polito, states the purpose is to satisfy the Pipeline and Hazardous Material Safety Administration (PHMSA) compliance order and allow the Middle Ground Shoal (MGS) to continue producing oil and gas, as well as decreasing the future likelihood of fatigue or abrasion leaks on these pipelines. The applicant proposes to lay 6.49 miles of dual (2) new 8” diameter pipelines from the MGS platform A to the MGS onshore facility, below the Mean High Water Mark (MHW) of the Cook Inlet (19.7’ above the 0.0’ contour) for the purpose of transporting oil and gas. The project site is located within Section 34, T. 8 N., R. 12 W., Seward Meridian; USGS Quad Map Kenai C-4 and D-4; Starting at Latitude 60.7368º N., Longitude 151.3490º W and ending at Latitude 60.7946º N., Longitude 151.4978º W.; near Nikiski, Alaska.   • POA-2009-00690-M2, Scaup Lake_PN

    Expiration date: 1/14/2022

    Hilcorp Alaska, LLC, Attention: Keegan Fleming, 3800 Centerpoint Drive #1400, Anchorage, Alaska 99503, states the purpose is to safely plug and abandon (P&A) the BHU Well No. 22-25. Discharge of fill material into wetlands is required to provide a stable base for constructing the road that would accommodate the P&A rig and associated equipment. Secondarily, the road would be utilized to provide access to their lands for subsistence and recreational activities for shareholders of TNC. The applicant proposes to discharge 13,000 cubic yards (CY) of gravel fill into 2.56 acres of wetlands for construction of a 2.4-mile-long permanent road, with a 16-20-foot crest width and a 33.5-foot base width, to P&A the BHU Well No. 22-25. The road would be left in place after P&A activities are complete for utilization by Tyonek Native Corporation for access to subsistence hunting. The project site is located within Section 14, 23, 24 and 25, T. 9 N., R. 9 W., Seward Meridian; USGS Quad Map Kenai D-3 SE; beginning at the intersection of Mountain Violet Drive and the Kenai Spur Highway Extension in the Gray Cliff Subdivision (Latitude 60.8703º N., Longitude 150.8265º W.) and terminating at the existing Birch Hill Unit (BHU) Well No. 22-25 (Latitude 60.8440º N., Longitude 150.7993º W.), within, and north of, the Kenai National Wildlife Refuge, northeast of Nikiski, Alaska.
