Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2021-00112, Kuskokwim River_PN

    Expiration date: 5/27/2021

    Adam Turner, with Vitus Energy LLC., states the project purpose is to provide fuel storage for Vitus's operations in Bethel, Alaska. Fuel stored at the tank farm will be delivered to local residents, filling stations, and other customers on an as needed basis. Work being proposed, is construction of a new bulk fuel tank farm and truck fill/offload facility in Bethel AK. The new facility will include approximately 34 30,000-gallon skid mounted, horizontal, aboveground storage tanks (ASTs) for bulk storage of diesel and gasoline situated within a lined, earthen, secondary containment dike. Other features will include a drive-in truck fill/offload secondary containment area, access drives, security fence, mechanical, electrical, lighting, and other associated systems. The proposed work will result in the placement of approximately 8,000 cubic yards of clean fill composed of sand and crushed rock into 4.5 acres of wetlands. Construction is targeted to start in June 2021, and is expected to be completed in August of 2021. All work would be performed in accordance with the enclosed plan (sheets 1-5), dated March 2021.   • POA-2021-00194, Clover Passage_PN

    Expiration date: 5/24/2021

    Mr. Sande states the projects purpose is to build a new single-family residence on the lot. The seawall and placement of fill into jurisdictional waters is necessary due to the geometry of the lot which is substandard lot geometry and is very long and extremely narrow. Work being proposed, Construct a seawall and building pad for a new single family residence on Lot 1, U.S.S. 3767 in Ketchikan, Alaska. The lot is 337 feet by 55 feet and the proposed seawall will be 337 feet long along the water with 18-foot long returns on each side terminating into the land. Seawall construction will require excavation of 80 CY and the placement of 200 cubic yards (CY) of concrete. A total of 1,250 CY of shot rock will be placed behind the seawall for the building pad. The bottom of the seawall will be constructed at the mean high water (MHW) line at 14.5 feet and the top of the wall be at 23-feet in elevation. A house, garage, parking, and on-site wastewater system with drain field will be constructed on the building pad. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated April 8, April 11, and February 16, 2021.   • POA-2006-02047, Fish Creek

    Expiration date: 5/3/2021

    Bartly Kleven, with Fairbanks Gold Mining In, states the project purpose is to profitably produce gold from mineral reserves on State of Alaska Land, utilizing open-pit mining methods and existing recovery processes. The work being proposed includes to develop the required infrastructure in order to mine the Gil Project. The first step is to upgrade the access road for moving mining equipment to the Gil Project in the fourth quarter of 2021. The main access road will be widened and impact 0.44 acre of wetlands and 0.18 acre of the freshwater reservoir, which will be reclaimed after three years. The mining will start on Gil Ridge in uplands in late 2021 and progress to Sourdough Ridge in 2023. Mining will end at both locations in 2023. Reclamation will commence in 2024 and progress through 2025. On site, monitoring will continue after reclamation. The ore from the open pits will be hauled to the existing Fort Knox processing facility. No wetlands or waters will be impacted at the Fort Knox processing facility. The proposed impacts for the Gil Project will include 3.27 acres of permanent impacts for mine roads and pit development.   • POA-2018-00123, Bonanza Channel/Safety Sound

    Expiration date: 5/17/2021

    Beau Epstein, with IPOP, LLC., states the project purpose involves two components: regulated activities associated with the proposed scientific information gathering plan (termed the “case study”) to provide supporting information for the previously proposed five-year mining plan and regulated activities of the five-year mining plan (previously described in Public Notice POA-2018-00123, Safety Sound/Bonanza Channel; issued July 31, 2020). The work being proposed includes work in the Bonanza Channel of Safety Sound, a Section 10 waterbody, and the dredging and discharge of dredged material into waters of the U.S. (the Bonanza Channel of Safety Sound and adjacent wetlands). All work would be performed in accordance with the enclosed plan (sheets 1-29), dated April 2021.   • POA-2012-00921, Tongass Narrows_PN

    Expiration date: 5/17/2021

    Mr. Perin states, the projects purpose is to increase the stable building area on the lot to construct a residential home, parking area and yard. Work being proposed, is to place 242 cubic yards (CY) of econo blocks (pre-made interlocking blocks that are uniform in width, length and height) into 0.02 acres to construct a concrete block wall and behind the wall place 3,056 CY of clean shot rock into 0.25 acres below the high tide line (HTL). Work is expected to take between six and eight months starting in Spring 2021. All work would be performed in accordance with the enclosed plan (sheets 1-5), dated April 2021. Mr. Perin is also proposing to install a wastewater outfall, which will likely be reviewed under a Nationwide 7 (Outfall Structures and Associated Intake Structures) once a complete application is received.
