Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2022-00408 Glacier Creek_PN

    Expiration date: 10/21/2022

    Mr. Brian Baldwin, 22601 Eagle Glacier Loop, Eagle River, AK 99577 states the purpose is to construct their residence and apartment planned for long-term rental. This is an after-the-fact permit application. The applicant requests after-the-fact authorization of the discharge of a total of 3,680 cubic yards of fill material into 0.26-acre of wetlands for the construction of a driveway and house pad. The applicant excavated 1,300 cubic yards of peat, using 1,150 cubic yards as backfill and spreading 150 cubic yards in 0.05-acre of wetlands in front of the house. The house pad and parking area was constructed with 2,380 cubic yards of gravel in 0.21-acre of wetlands. A sock drain was installed across the lot and releases water at the low corner of the lot (north corner of the property) and a silt fence and straw wattle line was installed for construction. All work was performed in accordance with the enclosed plan (sheets 1-3), dated September 21, 2022. The project site is located at Latitude 60.9589672º N., Longitude 149.1256345º W.; Alpine View Estates, in Girdwood, Alaska.     Northern Star (Pogo) LLC, POC: Michael Eckert, P.O. Box 145, Delta Junction, Alaska 99737, states the purpose is to expand existing facilities at the Pogo Mine to operate economically and safely for an additional ten years. The proposed work is a modification of activities previously authorized under POA-1996-00211. An additional total of approximately 4.9 acres wetlands would be permanently impacted by the proposed project from the following activities – the applicant is proposing to permanently impact approximately 2.6 acres wetlands by placing approximately 5,000 cubic yards of fill material to expand the Pogo Mine Dry Stack Tailings Facility (DSTF) and permanently impact 2.3 acres wetlands by placing 5,000 cubic yards fill material for the laydown area (Road 8 and Ruen Laydown Area). Non-mineralized rock from the property would be used as the fill material.     Municipality of Anchorage, Port of Alaska, 2000 Anchorage Port Road, Anchorage, Alaska 99501; Contact: Mr. Steve Ribuffo, 907-343-6201, steve.ribuffo@anchorageak.gov and agent HDR, Incorporated, 2525 C Street, Suite 500, Anchorage, Alaska, 99503; Contact: Mr. Michiel Holley, 907-644-2096, Michiel.Holley@hdrinc.com states the purpose is to create a new shoreline that is structurally and seismically stable and useable for port activities, while maximizing the retention of salvageable lands that were created under the Port Intermodal Expansion Project (PIEP) and supporting the improvement of hydrodynamic conditions of the USACE Anchorage Harbor project. The Port proposes to remove approximately 900 feet of unstable bulkhead and fill at the north end of the Port. The area, known as the North Extension, was constructed in 2009-2010 as part of the PIEP. The North Extension was never constructed to completion and is seismically unstable. This new proposed project, referred to as the North Extension Stabilization Step 1 (NES1) project, would remove the most seismically unstable portion (approximately half) of the North Extension. For the first stage of project, the Port will install soil improvements (deep soil mixing) along the proposed realignment of the shoreline to provide geotechnical stability to the embankment. The Port then proposes to construct an armor rock retaining wall inland of the current bulkhead; remove the fill between the existing bulkhead and new rock retaining wall to create an engineered laid-back slope with a top elevation of 38.0 feet MLLW and sloping to a toe elevation of approximately -40.0 feet MLLW; and then remove the open cell PIEP sheet pile wall that forms the current bulkhead through incrementally shearing and removing the sheet pile material and the impounded soils (PIEP fill material). The removal of fill behind the current bulkhead would require removal of approximately 1.33 million cubic yards of material, of which approximately 1.2 million cubic yards is below the waterline. The material above the waterline (approximately 130,000 cubic yards) would be excavated and separated into stockpiles of useable material and unusable material to be disposed of at a later time. The Port proposes to dredge the 1.2 million cubic yards below the waterline and place in the Anchorage Harbor in-water disposal site. The proposed project involves discharge of fill material below the high tide line of Knik Arm and construction of structures below the Knik Arm’s mean high water mark requiring require permits pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899. The project also proposes an alteration of the federal dredge limits of Anchorage Harbor, requiring review under Section 14 of the Rivers and Harbors Act of 1899 (33 U.S.C 408), hereafter referred to as Section 408. All work would be performed in accordance with the enclosed plan (sheets 1-21), dated June 2022. The project site is in Knik Arm, at the Port of Alaska, within Section 7, T. 13 N., R. 3 W., Seward Meridian; USGS Quad Map Anchorage A-8; Latitude 61.233499º N., Longitude 149.985068º W.; in Anchorage, Alaska.     Mr. Del Isabelle, P.O. Box 220021, Anchorage, AK 99522, states the purpose is to construct access to the private property near Root Beer and Mirror Lakes using public section line easements and rights-of-way. To discharge up to 8,500 cubic yards of select pit run gravel fill material into 1.7813 acres of wetlands in order to construct public access roads. A total of 6,597.77 feet of roads would be constructed. Of this length, up to 3,372 feet would be within wetlands. In wetlands, the road would be a maximum of 23 feet wide (toe-to-toe). Gravel fill material would be placed over Geotech fabric laid on top of the existing ground. Culverts, 12 inches by 20 feet long, would be placed as needed to maintain hydrology of the area. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated June 21, 2022.     Ms. Willow Hetrick, Kuukpik Corporation, 583 East 36th Avenue, Anchorage, Alaska 99503, states the purpose is to provide storage and staging areas for equipment and materials related to recent oil and gas development activities that support Kuukpik, its subsidiaries and joint venture entities. Kuukpik Oil Field Services (KOS) is proposing to discharge up to 79,095 cubic yards of clean gravel fill into 9.983 acres in order to construct a new lay down area/storage pad on lands owned and managed by Kuukpik Corporation. The proposed pad would be approximately 576 feet wide, 755 feet long, and be a minimum of 5 feet deep.
