Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2023-00052 Nazuruk Channel PN

    Expiration date: 4/30/2023

    Noorvik Native Community, P.O. Box 209, Noorvik, AK 99763 states the purpose is to construct a new roadway to provide safe access to a local cemetery near Noorvik. The proposed Middle Cemetery Road Project is being funded by the Bureau of Indian Affairs and will involve construction of a 0.98 mile long, two-way, single lane roadway to an existing cemetery that does not currently have road access. The roadway will be constructed to have a 10 foot wide travel lane with 6 foot wide shoulders. The road will be 60 feet wide at toe of slope. Also, the proposed roadway would end in a cul-de-sac at the cemetery and have four pullouts that are spaced approximately every 1,000 feet. The Middle Cemetery Road would be constructed as an overlay section on top of the existing ground without stripping vegetation or excavation to protect underlaying permafrost and reduce premature road degradation. These construction activities will result in the permanent loss of approximately 7.27 acres of wetlands. All work would be performed in accordance with the enclosed plan (sheets 1–8), dated November 23, 2022, and February 17, 2023. The project site is located approximately 1.8 miles southeast of Noorvik in Section 36, Township 17 North, Range 11 West, Latitude 66.822433° North, Longitude -160.983889° West, Northwest Arctic Borough, Alaska.   • POA-2023-00145 Moose Creek PN

    Expiration date: 4/28/2023

    Brett Nelson, Alaska Department of Transportation and Public Facilities (ADOT&PF), 2301 Peger Road, Fairbanks, AK 99709, brett.nelson@alaska.gov states the purpose is to reconstruct the Elliot Highway between MP 106.6 and MP 107.7 to improve public safety by widening the road so there is sufficient width for oncoming vehicles, to provide a consistent road width to match road widths (24 feet) at either end of the project, to construct drainage ditches to provide sufficient area for snow removal and improve drainage away from the roadway, and extend existing culverts and install cross drainage culverts where needed in previously disturbed areas. The proposed upgrades consist of 2.25 acres of permanent impacts from the discharge of approximately 566 cubic yards of fill into waters of the U.S. (WOTUS), including wetlands. Additional work associated with the proposed project includes the use of one material site and one staging area located in uplands (Figure 4, March 22, 2023). Work is proposed to start during the summer of 2023 and continue depending on resources available over the next three to five years. All work would be performed in accordance with the enclosed plan (sheets 1–3), dated March 22, 2023. The beginning of the project is located at Elliot Highway Mile Post (MP) 106.6 at approximately Latitude 65.2462° N, Longitude 149.4823° W; the end of the project is located at Elliot Highway MP 107.7 at approximately Latitude 65.2387° N, Longitude 149.5131° W. The Material Site (MS 680-052-2) is located on the Elliot Highway at MP 105.5. The staging area is located at a pullout at MP 106.5 just before the beginning of the project. The project site can be reached by taking the Elliot Highway north out of Fox, Alaska for approximately 73 miles, taking a left at Livengood, AK and following the Elliot Highway 34 miles to the beginning of the project.   • POA-2023-00117 Turnagain Arm PN

    Expiration date: 4/20/2023

    Titan, LLC – Todd Christianson, 251 West 106th Avenue, Anchorage, Alaska 99515, states the purpose is to mine the peat and organics currently on site to be repurposed for the landscaping business. The material will be hauled to an upland processing facility. The excavated site will be backfilled with clean fill material leaving a usable building and or construction pad for the property owner. The applicant is proposing to excavate 0.95-acre of wetlands and backfill the site with approximately 15,000 cubic yards of fill material to create a usable construction pad. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated March 2023. The project site is located within Section 18, T. 12 N., R. 3 W., Seward Meridian; USGS Quad Map Anchorage A-8; Latitude 61.124488º N., Longitude 149.884970º W.; from downtown Anchorage, travel south on AK-1 Seward Highway for 6.7 miles. Take the O'Malley Road exit, continue straight for one mile then take the exit to turn right (north) onto C Street. The site is located on the right-hand side (east), on the corner of C Street and 106th Avenue, in Anchorage, Alaska.   • Revised Public Notice POA-2003-00502-M20, Knik Arm

    Expiration date: 4/5/2023

    On March 6, 2023, the Alaska District U.S. Army Corps of Engineers published a public notice for Department of the Army (DA) permit number POA-2003-00502-M2, Knik Arm for a DA permit application from Municipality of Anchorage, Port of Alaska (Port). to remove approximately 900 feet of unstable bulkhead and fill at the north end of the Port referred to as the North Extension Stabilization Step 1 (NES1) project. The project site is in Knik Arm, at the Port of Alaska, within Section 7, T. 13 N., R. 3 W., Seward Meridian; USGS Quad Map Anchorage A-8; Latitude 61.233499º N., Longitude 149.985068º W.; in Anchorage, Alaska. The public notice showed an expiration date of March 21, 2023. The expiration date of this public notice has been extended to April 5, 2023.   • POA-2015-00451 Wetlands adjacent to Kuskokwim River PN

    Expiration date: 4/16/2023

    Yukon Kuskokwim Health Corporation, P.O. Box 528, Bethel, AK 99559 states the purpose is to provide housing and accommodations for employees and visitors of the Yukon Kuskokwim Health Corporation (YKHC) Hospital in Bethel, Alaska. The proposed work will involve the construction of a multistory apartment building on Lot-2 that is capable of providing approximately 50 one-bedroom units for YKHC temporary duty employees and 70 two-bedroom units for full-time local YKHC employees. Approximately 10,690 cubic yards of sand will be placed into Lot-2 to provide a 2.21 acre foundation for the new apartment building. To allow for the placement of needed construction equipment and materials, a permanent construction laydown yard will be constructed on Lot-52A to facilitate construction of the new apartment building and the ongoing construction work at the adjacent Qavartarvik Customer Lodging Facility. Approximately 8,408 cubic yards of sand will be discharged into Lot-52A to create the 2.06 acre construction laydown yard. These construction activities will result in the permanent loss of 4.27 acres of wetlands. Construction is expected to begin during the summer of 2023 with the construction of the laydown yard. Pile driving will begin in the winter of 2023, and the entire project is expected to be completed by the summer of 2025. All work will be performed in accordance with the enclosed plan (sheets 1–6), dated October 24, 2022.
