Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

POA-2013-457, Eek River

City of Eek stated purpose is to construct a new permitted Class Ill solid waste facility in accordance with 18 AAC 60, as regulated by Alaska Department of Environmental Conservation (ADEC).  The project also includes construction of a 1400-foot long by 12-foot wide boardwalk to access the new landfill.  The total impact of fill material placed into jurisdictional wetlands is 8.416 acres.  Proposed Work:  New Class Ill Landfill:  The applicant proposes to open a new permitted landfill that will serve the community for the next 20 years. Approximately 3.0 acres of wetlands will be permanently impacted by the discharge of fill material.  The existing dump site has exceeded its useful life and poses potential health, safety, and environmental hazards.  Trash is currently dumped in an uncontrolled area adjacent to a 3-acre pond. As a result, trash is accumulating in the pond and could potentially contaminate surface and ground water. Contaminants can affect public health and aquatic and terrestrial plants and animals coming in contact with the water.  Additionally, there is no heavy equipment present at the dump site; therefore, the waste is not compacted or covered and it attracts wildlife including ravens and foxes.  Wildlife may contract diseases from the exposed waste and may also spread it. Animals also become accustomed to this food sources and to human presence, increasing the potential for human-wildlife encounters that can lead to physical attack or disease transmission.
