Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2017-526, Piledriver Slough

    Expiration date: 3/22/2018

    PURPOSE: The applicant, Randy Reese, has stated his purpose as to establish a new residence for the Reese family and to ensure that their livestock can safety live on the land with adequate food, water, and shelter. LOCATION: The project site is located within Section 1, T. 4S., R. 3 E., Fairbanks Meridian; USGS Quad Map Fairbanks C-1; Latitude 64.5966º N., Longitude 147.0721º W.; Eielson Small Tracts, Tract C; southbound on Richardson Highway towards Salcha, turn right onto Stringer Road, then right onto Homesite Court. The property is on left at end of circle in Salcha, Alaska. PROPOSED WORK: The applicant proposes to clear vegetation and place approximately 92,000 cubic yards (cy) of gravel and 30,000 cy of topsoil as fill material in approximately 7 acres of wetlands for a residential house pad, yard, driveway access, livestock holding, and pasture areas. All work would be performed in accordance with the enclosed plans (sheets 1-2), dated February 5, 2018.     Mr. Stephen Ribuffo (Municipality of Anchorage, Port of Alaska) stated the purpose is to construct the Petroleum and Cement Terminal (PCT) to replace the existing Petroleum Oil and Lubricants Terminal (POL) 1 terminal with a new structure that exceeds current seismic standards. The project site is located within Section 7, T. 13 N., R. 3 W., Seward Meridian; USGS Quad Map Anchorage A-8; Latitude 61.23350º N., Longitude 149.98507º W.; in Anchorage, Alaska. The Municipality of Anchorage through its Port of Alaska Department (Port) proposes to construct the PCT project during 2018 and 2019. The Port’s permit application seeks two Department of the Army permits, one for each year. See the enclosed Permit Application for a complete project description.     Expiration date: 3/19/2018

    Sun’aq Tribe of Kodiak stated the purpose is “moorage of small boats that are used for commercial activities associated with the custom processing building Wildsource as well as future businesses that will occupy the new multi-use structure. The harbor will also continue to accommodate recreational boaters as well as water taxi and tour operators. The new dock will also provide a commercial crane for unloading vessels as well as a small float for temporary moorage.” The project site is located within Section 31, T. 27 S., R. 19 W., Seward Meridian; USGS Quad Map Kodiak D-2; Latitude 57.786492º N., Longitude 152.415310º W.; Alaska Tideland Survey 49, Tract N17B; 419 Shelikof Street, in Kodiak, Alaska. The applicant requests authorization for the following work in and over Chiniak Bay (Inner Harbor), which is a navigable water of the United States: 1. Discharge of 250 cubic yards of shot rock and 50 of concrete fill material in to a 300 square feet area below the High Tide Line (approximate elevation +11.5 feet, above the 0.0 foot Mean Lower Low Water (MLLW) contour) to construct a seawall; 2. Install below the Mean High Water Mark (MHW) (approximate elevation +7.9 feet, above the 0.0 foot MLLW contour), one pile-supported (46 each 12-inch diameter steel piles capped with 14-inch deep galvanized steel beams and 17 each pressure treated wood fender piles) new 13,000 square foot, concrete decked dock; 3. Install below the MHW, one 1,500 square foot new wood float, including one 50 foot long by 6 foot wide aluminum gangway; 4. Remove from below the MHW, one pile-supported (80 creosote treated wood piles) 5,000 square foot wood decked dock, including joists; 5. Remove from below the MHW, one pile-supported (41 steel piles) 2,500 dock consisting of 8-inch thick concrete panels; 6. Remove from below the MHW, 28 creosote treated wood piles. All work would be performed in accordance with the enclosed plan (sheets 1-8), dated November 7, 2017.   • POA-2014-375, Healy Creek

    Expiration date: 3/9/2018

    PURPOSE: Usibelli Coal Mine’s stated purpose is to extract commercial quantities of coal and reclaim the mining area to establish stable post-mining slopes, drainage configuration, and self-sustaining vegetation community consistent with wildlife habitats. LOCATION: The project site is located within Fairbanks Meridian; USGS Quad Map Healy-D4; Latitude 63.8652º N., Longitude -148.7747º W.; Usibelli Coal Mine, near Healy, Alaska. PROPOSED WORK: Usibelli proposes the discharge of fill material into waters of the United States (U.S.) to support coal mining activities within the Rosalie Mine area over a 20 year period. The discharges are to access the mining area, control surface and pit drainage, remove overburden and interburden material, and recover and remove the coal. The proposed project would involve the discharge of approximately 106,000 cubic yards (cy) of topsoil and 20 million cy of overburden and interburden material into 4.6 acres of wetlands, 12.7 acres of non-wetland waters, and 383.3 acres of uplands. Mining activities would be planned in sequence, from blocks 1 through 7. Reclamation of mine disturbance areas would occur contemporaneously with the mining operations. All work would be performed in accordance with the enclosed plan (sheets 1-17), dated January 2018. ADDITIONAL INFORMATION: Surface Coal Mining and Reclamation Act (SMCRA) permit approved 11/3/2014; Alaska Department of Fish and Game Fish Habitat Permit pending; Alaska Pollution discharge Elimination System permit, pending. The applicant proposes mechanical land clearing and discharge of 72,800 cubic yards of topsoil, 467,830 cubic yards of overburden and 151,530 cubic yards of pay material into 33.3 acres of waters of the U.S., in association with placer mining activities at the Jailhouse mining project. All work would be performed in accordance with the enclosed plan (sheets 1-6), dated February 2, 2018.
