Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

    Deborah Heebner, with Hilcorp, Alaska, LLC., 3800 Centerpoint Drive, Suite 1400, Anchorage, Alaska 99503, states that the purpose of this project is maintenance dredging and beach nourishment. The project site is located within Section 6, T. 13 N., R. 10 E., Umiat Meridian; USGS Quad Map Beechey Pt. C-5; Latitude 70.5076º N., Longitude 149.6606º W.; approximately 35 miles from Prudhoe Bay, Alaska. Work being proposed is the screeding/dredging of a 100’ x 60’ area (0.14 acre Estuarine Subtidal) in front of the barge landing at F Pad, down to 3.5’ below Mean Lower Low Water (MLLW) to provide enough clearance for incoming barges. If material needs to be dredged, it would be placed in a roughly rectangular area 800’ x 95’ (1.5 acres of Estuarine Intertidal) on the northwestern side of F Pad as beach nourishment. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated April 25, 2018. The stated purpose of the project is twofold, One; Waste dump facility and access road: Placement of contaminated waste rock from Aqqaluk and Qanaiyaq deposits into 31.7 acres, including uplands and wetlands. Two; Tailings storage pond: The placement of 68,085 cubic yards of clean fill into 12 acres of uplands, and the placement of 20,104 cubic yards of clean gravel into 12.5 acres of wetlands to raise the level of the Red Dog Mine Tailings Pond. This will include raising all sides of the tailings pond, including the main and back dams from 986 feet to 1,006 feet above mean sea level in phases between 2018 and 2024. The main haul road will also be relocated to accommodate the back dam raise. The approximate fill height would vary from roughly 30 inches to 108 inches. It is anticipated that there would be five culvert crossings in the road for storm water runoff, but location and number would be evaluated once construction has begun. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated March 2018.The project site is located within Section 29, T. 31N., R. 18W., Kateel River Meridian; Latitude 68.0520º N., Longitude 162.8479º W.; near Kivalina, Alaska.
