Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2021-00041, Sagavanirktok River

    Expiration date: 4/8/2021

    Mr. Brett Nelson, with Alaska Department of Transportation and Public Facilities, states the project purpose is to rehabilitate the Dalton Highway by preserving and extending the life of the highway to enhance public safety. The work being proposed is to permanently fill 80 acres of wetlands and 0.27 acre of open water with 346,705 cubic yards of gravel fill material, in order to establish a uniform road width with vehicle turnouts, raised embankment, and improve water drainage along the Dalton Highway between MP 289 and MP 305. All work would be performed in accordance with the enclosed plan (sheets 1-59), dated January 2021. The project site is located at south end at MP 289, Latitude 68.64706º N., Longitude -149.41167º W., and north end at MP 305; Latitude 68.76080º N., Longitude -148.88611º W., along the Dalton Highway on the North Slope near Slope Mountain, Alaska.     On February 26, 2021, the Alaska District Corps of Engineers (Corps) published a Public Notice for Department of the Army (DA) permit number POA-2020-00367, Brown’s Slough for a DA permit application from Dale Construction, to retain an existing unpermitted sand pit and to expand it by 4.6 acres. The project site is located within Section 11, T. 8 N., R. 72 W., Seward Meridian; USGS Quad Map Bethel D-8; Latitude 60.7946º N., Longitude 161.8674º W.; Chaney Subdivision Name, north of BIA road, in Bethel, Alaska.   • POA-2020-00367, Brown's Slough

    Expiration date: 3/29/2021

    Mr. Joseph B. Dale II, with Dale Construction LLC, states the project purpose is to sell sand. Proposed work is to discharge of fill material into 10.5 acres of Palustrine emergent (PEM) wetlands to expand an existing sand pit. This work was done after August 17, 2017, and required authorization from the U.S. Army Corps of Engineers (Corps). These wetlands are adjacent to Brown’s Slough which is considered a water of the U.S. This was an expansion of an historical pit consisting of approximately 24.9 acres of PEM wetlands that were cleared with mechanized equipment prior to 2005. The total existing impacts to waters of the U.S., including wetlands would be 35.4 acres. Additionally, the applicant would now like to further expand the pit by mechanically land clearing which would result in the discharge of material into an additional 4.6 acres of wetlands to bring the total size of the pit to 40 acres (represented by sheet 4 of 5). The expansion would be needed to provide the quantity of specified materials for the upcoming expansion of the Bethel Runway and Lower Kuskokwim School District projects throughout the area. The applicant would continue to excavate 50,000 cubic yards (CY) and potentially up to 150,000 CY of sandy material annually from the pit each year. This proposal would bring the existing sand pit into compliance with Section 404 of the Clean Water Act.All work would be performed in accordance with the enclosed plan (sheets 1-5), dated February 22, 2021.   • POA-2020-00500, Tongass Narrows_PN

    Expiration date: 3/22/2021

    Blarney Stone Enter, LLC, states the project purpose is to provide for the loading and unloading of concrete and rock from shore to barge for transport and vessel moorage. Work being proposed includes discharge of fill material and construction of structures within navigable water. Specifically, the work includes the discharge of 13,400 cubic yards (CY) of clean shot rock and 1,503 CY of large rock into 0.424 acres of tidal waters for the construction of a 150-foot-long by 134-foot-wide fill pad, 28-foot-long driveway, and a rock retaining wall around the fill pad; the construction of a 50-foot-long by 25-foot-wide barge ramp within the footprint of the fill pad; construction of a 60-foot-long by 7-foot-wide aluminum ramp and 80-foot-long by 14-foot-wide ramp; construction of a breakwater system consisting of a 80-foot-long by 30-foot-wide HDG Pipe with 5-foot steel bobber, four (4) 6,000-lb anchors attached by ¾-inch x 4.5-inch chain; and installation of a 30-foot-long, 4-inch diameter outfall. The project site is located at Section 6, T. 74 S., R. 95 E., Cooper River Meridian; Latitude 55.3718º N., Longitude 131.7227º W.; 4900 Shoreline Drive in Ketchikan, Alaska.     Ken Kerr states the project purpose is to construct a residential housing pad and road access to the lot. Work being proposed includes to discharge 2269 cubic yards (CY) of fill into 0.702-acres of palustrine wetlands for the construction of an 825-foot-long 25-foot wide access road and a 100 by 100-foot housing pad. All work would be performed in accordance with the enclosed plan (sheets 1-3), dated February 12, 2021.
