Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2022-00511 Bonanza Creek PN Revised

    Expiration date: 4/12/2024

    Alaska Department of Transportation and Public Facilities (ADOT&PF) stated the purpose of the Dalton Highway MP 120–135 Reconstruction Project (project) is to improve safety of the Dalton Highway between MP 120 through MP 135 and MP 135.5 through 138.1 using current design standards. The project site is located at Section 31, T. 41 S., R. 67 E., Copper River Meridian; USGS Quad Map Juneau B-2 SW; Latitude 58.2691º N, Longitude 134.5161º W; in Juneau, Alaska. PROPOSED WORK The proposed work consists of the original scope of work, along with the added expansion of the material site and the proposed repairs to the thermal berms consisting of 67.04 acres of permanent impacts to WOTUS from the discharge of approximately 160,707 cubic yards (cy) of fill, including 779,075 cy of excavation in WOTUS. Temporary impacts would be approximately 21.52 acres of WOTUS (see Tables 3 and 4). This project includes structural embankment replacement, realignments, widening, and resurfacing of the 15-mile segment. Additional scope added to this project includes the construction of thermal berms between MP 135.5-138.1, resulting in 7.12 acres of permanent impact and 5.07 acres of temporary impacts to WOTUS (included in the total impacts above). This work would constitute the first phase of a multi-phase project along the Dalton Highway between MP 109-144.   • POA-2022-00364 Fish Creek PN

    Expiration date: 4/5/2024

    Dave Scanlan, Eaglecrest Ski Area, stated the purpose is construct infrastructure and facilities upgrades which are the main components of the Eaglecrest Ski Area's Summer Development Project. The project site is located at Section 31, T. 41 S., R. 67 E., Copper River Meridian; USGS Quad Map Juneau B-2 SW; Latitude 58.2691º N, Longitude 134.5161º W; in Juneau, Alaska. PROPOSED WORK The applicant proposes to discharge 30,381 cubic yards of fill material into 8.8 acres of wetlands in order to construct infrastructure and facilities upgrades to support the Eaglecrest Gondola & Summer Activity Development Project. The proposed infrastructure and facilities in wetlands would include: a gondola base building area pad and path, gondola towers, bike trails, a gondola mid station, a tubing hill, a picnic shelter, access and support roads, expansion of parking areas, and quarries for fill material. All work would be performed in accordance with the enclosed plan (sheets 1-14), dated 2/16/2024.   • POA-2023-00058 Sawmill Cove

    Expiration date: 3/13/2024

    ***PUBLIC NOTICE REVISION*** On February 12, 2024, the Alaska District U.S. Army Corps of Engineers published a public notice for Department of the Army (DA) permit number POA-2024-00058, Sawmill Cove for a DA permit application from the City and Borough of Sitka, to construct a vessel haul out facility. The project site is located within Section 3, T. 56 S., R. 64 E., Copper River Meridian; USGS Quad Map Sitka A-4; Latitude 57.0478º N., Longitude 135.2289º W.; within the Gary Paxton Industrial Park (GPIP), in Sawmill Cove, near Sitka, Alaska. The notices and plans showed the footprint of the project area to be 1.09 acres. This information is incorrect and should instead read: 1.24 acres. All other information contained in the previous notice remains the same. Please bring this announcement to the attention of anyone you know who is or may be interested.   • POA-2022-00430_Johnson Slough, Wetlands_PN

    Expiration date: 3/15/2024

    The applicant, Native Village of Napakiak has stated the purpose is to modify an existing DOA authorization, POA-2022-00430, to include an additional 585 lf of pioneer road and a 1.35-acre laydown pad in support of the ongoing Managed Retreat Project in Napakiak, AK. The applicant also proposes to modify the currently authorized access road alignment between the permitted material site and Mission Rd. PROPOSED WORK: Construction of a new 585 lf pioneer road connecting the existing landfill road to the new material site which will entail the placement of roughly 1,355 cy of sand/silt fill over approximately 0.4 acres of wetlands. Construction of a 300 ft. by 180 ft. laydown pad for material preparation and staging which will consist of a 3 ft. thick sand/silt embankment with 2:1 side slopes, encompassing roughly 6,265 cy of material placed over roughly 1.35 acres of wetlands. Altering the alignment of the material site access road connecting the extraction area to Mission Rd. which is roughly 65 lf longer than the originally authorized alignment, resulting the placement of an additional 150 cy of fill over a further 0.05 acres of wetlands.   • POA-2024-00057 Yukon River PN

    Expiration date: 3/31/2024

    Stantec Consulting Inc to expand the existing gravel and rock mining area to produce more construction aggregate that is needed for construction projects in the region. In addition, the applicant proposes to construct a bypass road for mining haul trucks to reduce traffic going through town where the local school and residential housing is located and to improve safety for local residents. The project is located near the city of Marshall, approximately 75 miles north of Bethel on the lower Yukon River, and consists of the current and proposed mining areas (Latitude 61.9146º N, Longitude -162.0225º W), proposed bypass road (Latitude 61.8716º N, Longitude -162.0628º W), and an existing storage/facility location (Latitude 61.8653º N, Longitude -162.0648º W), Kusilvak Census Area, Alaska. PROPOSED WORK The proposed project would involve expanding an existing gravel and rock mining area to produce more construction aggregate that is needed for construction projects in the region. Specifically, the mining operation would expand to the north, which would require additional area for overburden placement, which would impact 3.8 acres of shrub wetlands. When mining ceases, waste rock and overburden will be graded to overall slopes of 3:1 (H:V). All work would be performed in accordance with the enclosed construction plans.
