Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2019-00473 Big Lake PN

    Expiration date: 3/4/2024

    April A. Tynan stated the purpose is to “provide a safe and happy place for family recreation, including a house and garage. The current state of the property is unsafe and creates challenges for children and elders to access the lake for activities such as swimming, boating, fishing, snow machining, and other activities.” The project site is located within Section 20, T. 17 N., R. 3 W., Seward Meridian; Latitude 61.5459º N., Longitude 149.8626º W.; near Big Lake, Alaska. PROPOSED WORK: The applicant proposes to discharge 15,419 cubic yards of gravel, sand, and gravel material into 1.91 acres of wetlands in order to create a residential pad. The residential pad would include space for an 80-foot by 100-foot house, an 80-foot by 80-foot boat house and garage, space for a front yard, backyard, septic tank, and water well. The proposed project would include an approximately 40-foot by 320-foot driveway and access road.   • POA-2023-00075 Nome Creek PN

    Expiration date: 3/1/2024

    Tim Hammond; Bureau of Land Management BLM EIFO, stated the purpose is to improve conditions to the Nome Creek Road. The project site is located within Section 24, T. 06 N., R. 4 E., Fairbanks Meridian; USGS Quad Map Circle B-6; Latitude 65.3364º N., Longitude -146.8273º W.; Travel from Fairbanks along the Steese Highway to mile post 57, then north on U.S. Creek Road to mile 7, then west 3.5 miles on Nome Creek Road; near Fairbanks, Alaska. PROPOSED WORK: The applicant proposed to discharge 160,000 cubic yards of gravel fill via mechanized land clearing in 23.2 acres of waters of the U.S. (WOTUS), including wetlands to extract gravel and sand needed to resurface Nome Creek Road. All work would be performed in accordance with the enclosed plan (sheets 1-2), dated January 23, 2024. The proposed work is estimated to commence in March of 2024 and completed by October 2029.   • POA-1979-00181 Port Valdez PN

    Expiration date: 2/23/2024

    Michael Wells, Valdez Fisheries Department Association Inc. (VFDA), stated the purpose is to provide VFDA with an inter tidal area to mature and hold spawning salmon for its annual hatchery egg take needs. Similar work has been conducted to maintain and modify the pond over the years. This project would remove sediment that fills in from time to time from the overspill of Solomon Lake which is transported down Solomon Creek and deposited in the brood pond and along the alluvial fan at tidewater. The project site is located within Section 16, T. 9 S., R. 6 W., Copper River Meridian; Latitude 61.0896º N., Longitude 146.2950º W.; near Valdez, Alaska. PROPOSED WORK: Dredge approximately 3700 cubic yards of gravel fill from existing inter tidal pond to a maximum depth of -2.3 feet MLLW. Additional dredging of 900 cubic yards of gravel fill would be removed from an inter tidal area of Solomon Creek between the pond and the fish weir identified as the upper channel. Except for 350 cubic yards of fill that would be placed above high water in the designated fill area located at Latitude 61.084593° N, Longitude 146.302668° W, all fill would be used to repair the ring dike to an approximate top width of 35 feet and a top elevation of 6 feet MLLW, creating a 10/1 slope on the interior of the pond. Existing rip rap would be salvaged and repositioned along exterior dike wall and new filter material and Class II Riprap would be added to armor the exterior side of the dike at a slope of 2/1 and reduce erosion. A cut out of dike between stations 7+00 and 9+00 would provide addition flushing and access at high tide. All work would be performed in accordance with the enclosed plan (sheets 1-10), dated March 15, 2023. In total, 4,600 cubic yards of material would be dredged below the MHWM, and 4,250 cubic yards of dredged material would be discharged in 3.865 acres of waters of the U.S. below the HTL.   • POA-2023-00519 Dry Creek PN

    Expiration date: 2/22/2024

    Matthew Emrick, Norton Sound Health Corporation (NHSC), stated the purpose is to construct additional staff housing and a storage facility for the Norton Sound Regional Hospital. The project site is located within Section 25, T. 11 S., R. 34 W., Kateel River Meridian; Latitude 64.501269º N., Longitude 165.380826º W.; off of Greg Kruschek Avenue in Nome, Alaska. PROPOSED WORK The proposed activity entails the discharge of approximately 72,607 cubic yards of fill into 8.8 acres of jurisdictional waters of the U.S., predominantly consisting of wetlands but also including a minor amount of streams. The unnamed on-site streams are tributaries of Dry Creek, a tributary of Norton Sound. These streams would be traversed by two access roads (linear sections of the proposed fill footprint connecting the southern and northern fill pads) that would each have two 36-inch diameter culverts. An additional 24-inch diameter culvert would be placed within the driveway connecting the property from Greg Kruschek Avenue, the nearest road.   • POA-2017-526 Piledriver Slough PN

    Expiration date: 2/22/2024

    Randy Reese, stated the purpose is to establish a pastureland for livestock. The project site is located at 6035 Homesite Court, Eielson Small Tracts, Tract C; southbound on Richardson Highway towards Salcha, turn right onto Stringer Road, then right onto Homesite Court. The property is on left at end of circle in Salcha, Alaska. PROPOSED WORK: The applicant proposes to clear vegetation and stockpile vegetation to create pasture for livestock. The clearing of vegetation and excavation to remove tree and shrub roots, and placement of plant material stockpiles would result in the discharge of fill material into about 23 acres of black spruce scrub-shrub wetlands. Land clearing is planned when the ground is frozen in spring or late autumn. All work would be performed in accordance with the enclosed plans (sheets 1-4), dated January 16, 2024.
