Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2014-375, Healy Creek

    Expiration date: 3/9/2018

    PURPOSE: Usibelli Coal Mine’s stated purpose is to extract commercial quantities of coal and reclaim the mining area to establish stable post-mining slopes, drainage configuration, and self-sustaining vegetation community consistent with wildlife habitats. LOCATION: The project site is located within Fairbanks Meridian; USGS Quad Map Healy-D4; Latitude 63.8652º N., Longitude -148.7747º W.; Usibelli Coal Mine, near Healy, Alaska. PROPOSED WORK: Usibelli proposes the discharge of fill material into waters of the United States (U.S.) to support coal mining activities within the Rosalie Mine area over a 20 year period. The discharges are to access the mining area, control surface and pit drainage, remove overburden and interburden material, and recover and remove the coal. The proposed project would involve the discharge of approximately 106,000 cubic yards (cy) of topsoil and 20 million cy of overburden and interburden material into 4.6 acres of wetlands, 12.7 acres of non-wetland waters, and 383.3 acres of uplands. Mining activities would be planned in sequence, from blocks 1 through 7. Reclamation of mine disturbance areas would occur contemporaneously with the mining operations. All work would be performed in accordance with the enclosed plan (sheets 1-17), dated January 2018. ADDITIONAL INFORMATION: Surface Coal Mining and Reclamation Act (SMCRA) permit approved 11/3/2014; Alaska Department of Fish and Game Fish Habitat Permit pending; Alaska Pollution discharge Elimination System permit, pending.     Applicant: Cecil Connor, General Manager, Arctic Gold Mining LLC, 2871 Nome Teller Highway, Post Office Box 1590, Nome, Alaska, 99762. email: c.connor@arcticgoldmining.com, phone: 907-387-0308 Cecil Connor, General Manager, Arctic Gold Mining LLC states that the purpose is for the commercial production of gold. The project site is located within Sections 10, 11, 14, and 15, Township 11 S, Range 34 W, US Quad Map Nome C-1, Kateel River Meridian. Latitude 64.5433 N, Longitude 165.4294 W. in Nome, Alaska. The applicant proposes mechanical land clearing and discharge of 72,800 cubic yards of topsoil, 467,830 cubic yards of overburden and 151,530 cubic yards of pay material into 33.3 acres of waters of the U.S., in association with placer mining activities at the Jailhouse mining project. All work would be performed in accordance with the enclosed plan (sheets 1-6), dated February 2, 2018.     Expiration date: 3/2/2018

    Elizabeth Greer, of Alaska Industrial Development and Export Authority, say's the stated purpose is the following: “Planned increases in fuel consumption at the Red Dog Mine require construction of an additional three million gallons of diesel storage. The facility is able to receive fuel deliveries from ocean going fuel barges from approximately early July to mid-October, depending on sea and ice conditions. To meet operational needs, the facility needs to be able to store approximately nine months of diesel usage with a sufficient buffer to schedule fuel barge deliveries to minimize impacts to local subsistence activities”. The Proposed Work would include discharge of 11,460 cubic yards of sand and gravel fill into 1.3 acres of wetlands to construct a gravel pad for diesel bulk fuel storage. All work would be performed in accordance with the enclosed plan (sheets 1-6), dated December 20, 2017. The project site is located within Section 10, T. 25N., R. 24W., Kateel River Meridian; Latitude 67.5770º N., Longitude 164.0480º W.; near Kivalina, Alaska.   • POA-2005-744

    Expiration date: 2/23/2018

    Cap Shafer (Dibble Creek Rock, LTD) stated the purpose is to construct a facility for “handling, sorting, re-purposing, and disposal of fill material resulting from small and larger civil projects”. The project site is located within Section 32, T. 5 S., R. 14 W., Seward Meridian; USGS Quad Map Seldovia C-5; Latitude 59.6941º N., Longitude 151.6894º W.; adjacent to the Sterling Highway approximately 0.344 miles north of Mile Post 166, near Homer, Alaska. The applicant requests authorization to discharge approximately 12,000 cubic yards of peat, 75,000 cubic yards of overburden soil material and 12,000 cubic yards of wood fill material in up to 1.97 acres of waters of the United States consisting of palustrine wetlands in order to construct a waste material sort and stockpile area. The proposed work would be performed during winter months, and the applicant estimates that the site would be in use for two years.   • POA-2017-587, Silver Creek

    Expiration date: 2/21/2018

    PURPOSE: The project site is located within Section 35, T. 2 N., R. 1 W., Fairbanks Meridian; USGS Quad Map Fairbanks D-2; Latitude 64.9564º N., Longitude 147.6995º W.; located approximately 120 feet west of Steese Highway off of Goldstream Road in Fairbanks, Alaska. LOCATION: Mr. Flodin's, stated purpose is to construct an access road to his property. As part of this project, 6 lots are being created for the University of Alaska in exchange for the proposed public right-of-way. PROPOSED WORK: Placement of fill material in 4 acres of wetlands for creation of an access road and development of 6 residential lots. All work would be performed in accordance with the enclosed plan (drawings 1-5) dated November 2017.
