Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2022-00495 Liberty Falls_PN

    Expiration date: 2/8/2023

    Alaska Department of Transportation and Public Facilities (DOT&PF), 2301 Peger Road, Fairbanks, Alaska 99709, states the purpose is to resurface the Edgerton Highway from Mile Post (MP) 24 to MP 29 in order to preserve and extend the service life of the highway and to enhance safety. The roadway would be repaved using Hot Mix Asphalt. To achieve this, the current roadway is proposed to be reclaimed using a milling machine or reclaimer. The surface is proposed to be graded and paved to as-built conditions. In addition to resurfacing, the following activities are proposed: Vegetation clearing along the proposed alignment (within the right of way boundary) and in material sites, replace signs, replace guardrails, reconditioning ditches, replace existing culverts, reapplication of pavement markings, and resurface approaches. Two 24 inch culverts would be replaced with 36 inch culverts along the project corridor for cross-drainage along the highway between MP 27 and MP 28. Replacement culverts at these locations would be installed in the same place and at the same depth as existing culverts using half width construction. Following culvert replacement work, discarded culverts and any temporary fill material in wetlands would be removed, then disturbed areas graded and seeded. Approximately 0.1-acre of palustrine scrub-shrub (PSS) wetlands would be temporarily impacted to support the replacement of two cross-drainage culverts. Temporary impacts would result from a 50 foot wide work area that would be driven on by construction equipment. If there is standing water, then perimeter control using best management practices (BMP’s) would be installed. Temporary wetland impact areas would be rehabilitated following construction activities. Materials for this project would be from these existing material sites (MS): MS 850-032-5 (South Liberty Falls Pit), and MS 850-033-5 (North Liberty Falls Pit). The project would utilize approximately 2,000 cubic yards of D-1 and 3,800 cubic yards of paving aggregates. Approximately 3 acres of PSS wetlands would be permanently impacted from removal of material at the North Liberty Falls Pit. All work would be performed in accordance with the enclosed plan (sheets 1-18), dated October 30, 2007, and October 14, 2022.   • POA-2007-01820-M1 Sapsuk River PN

    Expiration date: 2/6/2023

    Rodney Schuh, Hoodoo Sport Fishing Adventures, LLC, 10000 Cobra Street, Anchorage, Alaska 99507, states the purpose is to install a cross airstrip to facilitate the safe operating of aircraft associated with the safe transportation of guests to and from the lodge when wind conditions are too extreme and unsafe to utilize the existing airstrips. The applicant proposes to discharge 7,000 cubic yards of sand/clay/silt, topped by 925 cubic yards of gravel/sand material into 0.8-acre of wetlands for the construction of a cross airstrip at an existing fishing lodge facility. The runway would be underlain by geotextile fabric and have a base width of 70-foot, a crest width of 50-foot and would extend 500 linear foot in wetlands. An 8-inch diameter culvert would be installed every 200-foot to maintain hydrology within the wetland. All work would be performed in accordance with the enclosed plan (sheets 1-5), dated November 30, 2022.   • POA-2022-00526 Turnagain Arm PN

    Karen Keesecker, Chugach Electric Association, Inc.; P.O. Box 16300; 1200 East 1st Avenue; Anchorage, Alaska 99519, telephone (907) 762-4726, and email: Karen_Keesecker@chugachelectric.com states the purpose is to serve the public interest by rebuilding and upgrading approximately 15 miles of existing 115kV transmission located between Girdwood and Indian. It would increase the transmission capacity to 230kV standards to maintain reliability and accommodate anticipated electrical load growth. Inspections conducted in 2007, concluded that the transmission line structures were nearing the end of their useful life and required replacement. The entire transmission line is 90.4 miles and runs from Quartz Creek Substation near Kenai Lake to the substation in Anchorage, which was originally constructed to carry power from the Cooper Lake Hydroelectric Power Plant to Anchorage. Today, this line also carries power produced by the Bradley Lake Hydroelectric Facility and the Nikiski Combined Cycle Power Plant. In addition to Anchorage, the line also serves local distribution substations at Indian, Dave’s Creek, Summit Lake, Hope, Portage, and Girdwood, and interconnects with the power grid for Seward, Kenai/Soldotna, and Homer. The project proposes to rebuild the electrical transmission segment between Girdwood Substation to Indian Substation (15 miles), which would require placement of 15,000 cubic yards of gravel and riprap and 305 cubic yards of pipe and concrete in 1.97 acres of waters of the U.S., including wetlands. The project is located within T. 10 N, R. 1 E, Sections 21-24, 29, 30; T. 10 N, R. 2 E, Section 1; T. 10 N, R. 1 W, Sections 5, 9-10,14-15, 24-25; T. 11 N, R. 1 W, Section 32 of the Seward Meridian. The proposed project extends from the Indian Substation (Latitude 61.000456° N, Longitude 149.499293° W) to the Girdwood Substation (Latitude 60.941448° N, Longitude 149.171027° W), near Girdwood, Alaska.     Mr. Emil Nelson, Post Office Box 130, Homer, Alaska 99603, states the purpose is to provide needed sport and commercial boat and gear storage for the public and industry in the Lower Kenai Peninsula. The existing storage yard is completely full and requests continue to be submitted for the waiting list. The Volcano Storage Yard is optimally located in proximity to the Homer Spit and Harbor. The applicant proposes to discharge 2,933 cubic yards of pit run gravel into 0.59-acre of palustrine forested/scrub-shrub wetlands to expand an existing parking and storage pad. Fill would be placed at a depth of two to three foot to match the elevation of the existing storage yard.     Boyer Towing, point of contact: Mike Cloudy; Phone: 907-225-2090: Post Office Box 8000, Ketchikan, Alaska 99901, states the purpose is to is to continue improvements to the owners’ property in support of their barge and tugboat business. The applicant proposes to improve mooring and erosion control in support of a mooring/loading facility. This will be accomplished through the installation of 1) an additional five (5) 24-inch or 36-inch dolphins to continue the pier line along the property, 2) up to seven (7) 16-inch piles to secure a 6-foot by 180-foot floating dock on the shoreside of the mooring piles, 3) approximately 35-foot wide by 25-foot deep barge loading bulkhead, which will consist of sixteen (16) 12-inch steel H piles installed in drilled rock sockets, a poured concrete backwall and approximately 400 cubic yards of backfill (350 cubic yards clean shot rock and 50 cubic yards stacked rip rap), 4) twelve (12) concrete and steel bridge deck panels to prevent further erosion of the ramp and 5) a 6-foot by 70-foot aluminum gangway and 20-foot by 20-foot floating dock. All work would be performed in accordance with the enclosed plan (sheets 1-10), dated October 17, 2022.
