Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

Email: MattC.Dunn@north-slope.org; telephone: 907-852-0253, states the purpose is to divert erosional water flow away from the SA-10 reservoir, with the goal of returning flow conditions as they were prior to the mining that occurred upstream in 2006. Construction of an approximate 9,950 foot channel along the westerly Sag River floodplain, which would redirect waters away from the reservoir walls and into other existing channels of the Sag River. Material removed to form the channel will be used to construct an approximate 8,100 foot dike (berm) westerly of the proposed channel, between the proposed channel and the western bank of the River. The dike is necessary to prevent waters from continuing to flow towards the reservoir walls, especially during in high water events. The project site is located within Sections 20 & 29, T. 10N., R.15 E., Umiat Meridian; Point Roberts OE N; near Latitude 70.19669º N., Longitude 148.386947º W.; North Slope Borough, in the Sagavanirktok river channel east of the existing NANA SA-10 freshwater reservoir in Deadhorse, Alaska.     Mr. Craig C. Coggins, P.O. Box 1435, Nome, Alaska 99762; Phone 907 299-4292. Email: cogginsacak@gmail.com, states the purpose is to conduct offshore suction dredging for gold. Conduct an offshore suction dredging operation, using a 20-inch diameter suction nozzle mounted on a 12-ton, 30-foot long by x 8 foot wide, underwater, custom-built track crawler. The crawler operation is supported by a 66 foot by 20 foot landing craft vessel, anchored offshore and working in 40 to 60-foot depth waters. The dozer moves seabed gravels and cobbles 11/16th inch-plus size into 2-to-3-foot-high rows of tailings. 11/16th-minus sized materials are sucked up by the dredge hose, pumped to the vessel, sluiced, and returned to the ocean floor through an 8 inch diameter hose, 20-to-30 feet below the surface. Up to 20 cubic yards per hour of material would be processed. All dredged materials are returned to the ocean floor in approximately the same location from which they were removed, with reclamation conducted concurrently. The support boat would be serviced from the Nome Boat Harbor. All work would be performed in accordance with the enclosed plan (sheets 1-3), dated March 3, 2022. The project site is located offshore from Nome, Alaska, within Alaska Department of Natural Resources' 2011 Lease Sale Tracts and Alaska Division of Lands parcels.   • POA-2022-00055, Nushagak River_PN

    Expiration date: 3/26/2022

    Nushagak Cooperative; Trung Vo, 907-842-5251, states the purpose is to install new fiber optic cable to Aleknagik and Dillingham via connection to an existing fiber optic cable in the Levelock area. This will provide needed middle mile transport to the Nushagak Telephone Cooperative exchange area allowing the offering of improved broadband for those areas, with the additional benefit of potential backhaul for the provider at Ekwok. With the installation of this new "middle mile" fiber optic cable, new Fiber To The Home (FTTH) will be installed in the Village of Aleknagik. Upon completion, both Aleknagik and Dillingham will be brought up to current standards for available broadband, and in tum will also provide increased broadband for schools and medical facilities. The applicant proposes to discharge 6,755-cubic yards of fill into 57.5-acres of Waters of the United States (WOUS), including wetlands, to install approximately 70 miles of fiber optic cable between the cities of Aleknagik, Ekwok, and Levelock, Alaska. The proposed project would result in less than 0.01-acres permanent impacts and 57.49-acres temporary impacts to WOUS. Vegetation would be cut and grubbed along the route to allow passage of trenching equipment and crews. Trenching equipment would excavate a 6-inch-wide slot by 2-feet deep, temporarily side cast excavated material, install the fiber optic cable, and then backfill the trench. Boring equipment would be used at 7 river crossings, to install the cable a minimum of 3.5-feet under the riverbed. Splice vaults to provide access to the buried cable would be set in place every 20,000 feet, and at both sides of a river boring. All work would be performed in accordance with the enclosed plan (sheets 1-61), dated January 22, 2022. The linear project site is located within multiple Townships, Ranges, and Sections (see plan sheets); Seward Meridian; USGS Quad Maps Dillingham B-8 SE, B-7 SW, B-7 SE, B-6 SW, B-6 SE, B-5 SW, B-5 SE, B-4 SW, B-4 SE, A-4 NE, A-3 NW, A-3 NE; between terminus at Latitude 59.26756º N., Longitude 158.62652º W. and terminus at Latitude 59.15734º N., Longitude 156.88230º W.; the project runs cross country from Aleknagik to Ekwok and a point approximately three miles north of Levelock, Alaska.     Trilogy Development LLC, Point of Contact: Jason Weisser, Post Office Box 2913, Homer, Alaska 99603 states the purpose is to create affordable residential parcels served by municipal services within the City of Homer to meet the continued high demand from existing residents who currently rent, and incoming residents, for such parcels. A total of 40 parcels, many at the minimum size allowed by the city for the zoning district, would be created by this project. The applicant proposes to discharge 2,696 cubic yards of granular fill into 0.67 acre of wetlands to construct roadways, utility lines, driveways and building pads for the development of the 40-parcel Jack Gist Subdivision No. 3. Additionally, there would be 6,051 square foot (0.14 acre) of permanent wetland impacts through hydrologic isolation (impoundment), resulting in overall permanent impacts to 0.81 acre of waters of the U.S., including wetlands. The above includes 2,200 cubic yards of fill into 0.55 acre of wetlands for right-of-way, utility locate and road construction and 496 cubic yards of fill into 0.12 acre of wetlands for lot development consisting of driveway and house pad construction. Building lots containing wetland would have utility lines installed within the proposed driveway alignment to avoid additional wetland impacts. Wetland impacts due to driveway and building limits for each lot are shown on Sheets 3 and 4. All work would be performed in accordance with the enclosed plan (sheets 1-35), dated January 20, 2022.
