Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2019-00381, Ketchum and Mary Louise Creeks_PN

    Expiration date: 3/13/2022

    Mr. Jack Phipps, JVP Construction, Incorporated, 692 Eton Boulevard, Fairbanks, Alaska 99709. The applicant’s stated purpose is gold recovery by the use of placer mining. All access roads are pre-existing and located within uplands. The applicant’s proposed work is to mine gold from the 6.0-acre project site by using a placer mining system consisting of an eight feet long trammel with a sluice box and a three-foot-wide oversized conveyer. The project would involve the placement of approximately 48,000 cubic yards of gravel fill, consisting of approximately 40,000 cubic yards of rock, cobble, and gravel fines, and approximately 8,000 cubic yards of organic overburden annually, via mechanized land clearing in 6.0 acres of wetlands. Additional work includes an approximately 880 feet long by 15 feet wide by 6 feet deep temporary stream diversion of Ketchum Creek which was constructed in 2019 to present. The physical wash plant would remain in the same location and project plans from 2019 and would not change for the plant. Pay gravels would be delivered to the location from the new mining cuts to be processed. The project has been designed to occur in phases. All work from the 2019-2021 mining seasons have been reclaimed by utilizing a rolling footprint, and reclamation work has been accepted. During the 2022 mining season the remaining cuts of Ketchum Creek near the confluence of Upper Ketchum and Mary Louise Creeks will be completed. Upon completion of work the stream diversion in Ketchum Creek will be reclaimed prior to starting work in Mary Louise or Upper Ketchum Creeks. Next, from 2022 to 2023, the operation will proceed with work within Mary Louise Creek. An approximately 2,000 feet long by 15 feet, wide by 6 feet deep temporary stream diversion would be constructed. Mining would consist of work within the streambed and also within previously mined ground along the Mary Louise Creek mining areas. Once work at Mary Louise Creek is finished, and the stream bypass and mining cuts reclaimed, work would advance to Upper Ketchum Creek. Mining of the Upper Ketchum Creek area is expected to occur from 2023 to 2025. Test trenches, sized approximately 500 feet long by 5 feet wide by 15 feet deep will be excavated to survey for profitable gold resources. Ground at the Upper Ketchum Creek location has also been previously mined, and additional work will include an approximately 660 feet long by 15 feet, wide by 5 feet deep temporary stream diversion. The planned cuts and would be reclaimed after the completion of the mining process. All work would be performed in accordance with the enclosed plan (sheets 1-20), dated February 8, 2022. The project site is located within Sections 1, 7, & 12, T. 7 N., R. 14 7 15 E., Fairbanks Meridian; USGS Quad Map Circle B-2; Latitude 65.457497º N., Longitude 144.756348º W.; near Central, Alaska.   • Final PN_POA_NWP_RCs_Feb_10_2022

    Expiration date: 3/14/2026

    On December 27, 2021, the U.S. Army Corps of Engineers (Corps) published a final rule in the Federal Register (86 FR 73522) announcing the reissuance of 40 existing nationwide permits (NWPs) and one new NWP. These 41 NWPs will go into effect on February 25, 2022, and they will expire on March 14, 2026. The other 16 nationwide permits were (re)issued on January 13, 2021 and went into effect on March 15, 2021.

  • POA-1994-01014, Orca Inlet_PN

    Expiration date: 3/7/2022

    Native Village of Eyak (NVE), PO Box 1388, 110 Nicholoff Way, Cordova, Alaska 99574, states the purpose of project has not changed from that described in Section 1.2 of the 2006 FEIS. The project purpose is to: • Construct an Oil Spill Response Facility and deep-water port in the Cordova area that could receive oil spill equipment from any location at all tides, via an air-to-ground-to-response-vessel or cargo vessel-to-response-vessel transportation sequence, • Accommodate existing and foreseeable future oil spill response vessels and oil spill response-related cargo vessels with deeper drafts than can be accommodated by existing facilities in the area, and • Include an adequately sized area, contiguous to the dock, for staging and storing response equipment. The proposed permit modification include: 1) Road realignment near Humpback Creek, 2) Reduce road length from 4.5 miles to 4.32 miles, 3) Bridge crossings at No-name Creek, 4) Shepard Point pad and staging area increase from 3.5 acres to 5.5 acres, 5) Install interlocking steel sheet pile retaining wall at Shepard Point pad and staging area, 6) Boat ramp configuration change, and 7) Remove 2017 DA Permit POA-1994-01014 Special Condition 5. The project site is located within Sections 1, 2, 10, and 11, T. 15 S., R. 3 W., Copper River Meridian, USGS Quad Map Cordova C-5; between Latitude 60.578259° N., Longitude 145.721472° W.; and Latitude 60.630286° N., Longitude 145.671076° W.along Orca Inlet in Prince William Sound, near Cordova, Alaska.     On January 28, 2022, the Alaska District Corps of Engineers published a Public Notice concerning an application received from the Alaska Department of Transportation.   • POA-2022-00032 Sagavanirktok_River_PN

    Expiration date: 2/28/2022

    Alaska Department of Transportation and Public Facilities, Attention: Brett Nelson, stated purpose is to provide aggregate gravel to extend the life of existing road surfaces and to complete maintenance and structural rehabilitation work to meet safety and design requirements for the Dalton Highway. The applicant proposes to excavate, within freshwater forested/shrub and emergent wetlands, a new mining cell to a depth of 30 feet and 10 acres in area, to provide a source and stockpile area for aggregate gravel. The proposed new cell would be within an existing material site area. Waste rock and overburden material would be used to backfill the current or adjacent gravel mine cells or blocks. Mined areas regraded to final slopes would have overburden organic materials spread over the surfaces to aid in revegetation and seeded with native plant species. There is an existing access to the site at MP 390. The proposed work is scheduled to occur during the summer and fall construction seasons. All work would be performed in accordance with the enclosed plan (sheets 1-2), dated December 2021. The project site is located within Latitude 69.8898º N., Longitude 148.7678º W.; MP 390, east of the Dalton Highway, Alaska.
