Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2012-902, Falls Creek

    Expiration date: 4/27/2015

    Mr. Louis Fry's stated purpose is to develop a home site for family, storage for equipment, and seasonal housing for visiting family. Mr. Louis Fry is proposing to develop a privately owned lot for his family, equipment, and visiting family. The work would include the placement of fill material into 0.576-acre of wetlands and the installation of bottomless arch culverts over intermittent unnamed tributaries in association with the construction of the home site and attendant features. See Sheet 2 of 4 for dimensions of all proposed jurisdictional fill areas.   • POA-1998-882, Port Valdez,

    Expiration date: 4/22/2015

    Harris Sand and Gravel, Inc's stated purpose is to load barges primarily with riprap and other gravel products at low tidal levels in support the Valdez Harbor Project. To relocate and discharge up to 296 cubic yards of native material into 1.14 acres of intertidal area in order to construct a barge dock that is usable at extreme low tides. Up to a 0.18-acre area would be dredged in order to obtain material to construct the barge dock. Therefore, the total impact area would be 1.32 acres. The barge dock would be up to 213 feet wide at the widest part (toe-to-toe) with 3:1 side slopes, and up to 288 feet long. No material would be brought from other sources to construct the barge dock. The barge dock front would have a bulkhead constructed of eleven (11) 14-inch diameter steel piles, supported by a 14-inch by 14-inch “I” beam on top, and up to four (4) concrete “tee” beams. The bulkhead would be further supported by being connected to two (2) log dead men embedded in the barge dock. Two dolphins each consisting of two (2) 14-inch diameter steel piles would be installed near the northern end of the barge dock. All piles would be driven to a maximum depth of -27 feet, and would be installed with a vibratory hammer. All work and fill would occur below the Mean High Water Line. The barge dock would be temporary with an anticipated lifespan of five (5) years, which is when the Valdez Harbor Project is projected to be complete. The barge dock and all supporting features would be removed at the end of this time. Site restoration is discussed in further detail in the “Additional Information” section of this Public Notice.     **PUBLIC NOTICE EXTENSION*** On November 3, 2014, the U.S. Army Corps of Engineers, Alaska District, published a Public Notice for a Department of the Army (DA) permit application, POA-2014-423, Chilkat River, to discharge naturally occurring slide material from the Takshanuk Mountains into the Chilkat River, adjacent to the Haines Highway. The project site is located within Section 9, Township 29 S., Range 57 E., Copper River Meridian; USGS Quad Map AK-Skagway B-3; Latitude 59.37307º N., Longitude -135.83437º W.; Mile Post 19 of the Haines Highway; near Haines, Alaska. Due to elevated interest in the community of Haines and the local media, we have decided to reopen the November 3, 2014 Public Notice for comments. The only information that has been modified since our November 3, 2014 publication is the mailing address for the Kenai Field Office and the phone number for Michael Setering, the point-of-contact for this notice. All other information is unchanged. Please bring this announcement to the attention of anyone you know is or may be interested.   • POA-1982-598-M20, Captains Bay

    Expiration date: 4/9/2015

    Offshore Systems, Inc. (OSI) proposes to discharge 38,800 cubic yards (cy) of gravel/cobble fill and 5,800 cy of armor rock would be discharged into 2.70 acres of waters of the U.S., below the high tide line (HTL, approximate elevation +4.7 foot above 0.0 foot elevation) and mean high water mark (MHWM, approximate elevation +3.4 foot above 0.0 foot elevation) of Captains Bay, a navigable water of the U.S., to expand an existing dock to serve as a high load capacity area for the offloading of barges and material handling/staging. Offshore Systems, Inc. (OSI) stated purpose is to ensure the safety and efficiency of crucial marine freight services at the OSI dock in Captains Bay by increasing the dock area.   • POA-2015-96, Cache Creek

    Expiration date: 4/9/2015

    The applicant, Mr. Douglas Baker's stated purpose is a placer mining operation designed to economically recover gold and complete acceptable reclamation. lay-down yard. PROPOSED WORK: The applicant proposes to mine on his State mining claims under APMA 2624. Excavation and discharge of overburden would be conducted to allow the excavation of 4’-6’ of pay gravels located under the overburden allowing for the extraction of gold from the pay gravels. Overburden would be placed in both an existing flooded pit and as backfill in the newly excavated areas, reclaiming the excavation to original ground with several remaining shallow ponds, enhancing the wetland value. Comments on the described work, with the reference number, should reach this office no later than the expiration date of this Public Notice to become part of the record and be considered in the decision.
