Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • Clean Water Act Interpretive Rule for 404(f)(1)(A) Withdrawal

    The U.S. Environmental Protection Agency (EPA) and the U.S. Department of the Army (Army) are announcing the withdrawal of an interpretive rule addressing the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA). The agencies want to make clear that the statutory exemption of 404(f)(1)(A) still remains available for use when applicable for discharges of dredged and/or fill material associated with normal farming, silviculture, and ranching activities that are part of an established operation and that do not have as their purpose bringing an area of waters of the U.S. into a use to which it was not previously subject, where the flow or circulation of the waters of the U.S. may be impaired or the reach of such waters be reduced (see 33 CFR 323.4 for more information).
  • POA-2013-665-M1, Sagavanirktok River

    Expiration date: 3/3/2015

    The Alaska Department of Transportation & Public Facilities' stated purpose is to extract gravel for the rehabilitation of the Dalton Highway MP 401-414, (as authorized under POA-2013-665, dated November 7, 2014). The proposed gravel pit is needed for the construction of the Dalton Highway project. This public notice only concerns the proposed gravel pit. PROPOSED WORK: The proposed project would involve the extraction of gravel material from up to 45 acres below ordinary high water on a gravel bar adjacent to the active channel by excavating a linear trench that would eventually function as a river channel. The applicant also proposes to permanently impact up to 46 acres of palustrine emergent wetlands adjacent to the Sagavanirktok River, for haul road construction as wells as staging area and/or stockpile pads. An additional 90 acres below ordinary high water in the Sag River would be temporarily used as a staging and stockpile area. (The temporary stockpiles would not be placed in open water). All work would be performed in accordance with the enclosed plan, (sheets 1-5 dated November 2014). Comments on the described work, with the reference number, should reach this office no later than the expiration date of this Public Notice to become part of the record and be considered in the decision.   • POA-2013-40, Kuk River_PN

    Expiration date: 2/27/2015

    Olgoonik Corporation's stated purpose is to excavate and stockpile gravel to be used for constructing and maintaining Wainwright’s roads, housing, public facilities, and airport. The project site is located within Section 11, T. 14 N., R. 31 W., Umiat Meridian; USGS Quad Map Wainwright C-2; Latitude 70.5771º N., Longitude 159.8301º W.; six miles southeast of Wainwright, Alaska. Proposed Work: Develop a gravel material pit by mechanized land clearing of 16 acres of jurisdictional wetlands, the pit would be utilized for projects within the community of Wainwright. The pit would be linear is shape with the upper portion being 2000’ x 175’ and the lower portion being 1000’ x 350’. The western side of the pit would have a minimum 25’ buffer from the Kuk River and the eastern side would also have a 25’ buffer from the pond. The pit would be developed during frozen soil conditions. Side slopes would be graded to 2H:1V. Overburden would be stored within a 60-foot by 60-foot area on the inside edge of the pit for reclamation. Excavated material would be loaded directly into trucks for haul over shore-fast ice to an existing upland storage area 2.1 miles north of Wainwright. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated October 2014.   • POA-2007-870, Near Island Channel

    Expiration date: 2/27/2015

    Trident Seafoods Corporation's stated purpose is to perform dredging operations at the Trident Seafoods dock in Kodiak to accommodate safe vessel movements along the existing dock face. Trident Seafoods Corporation would dredge 1,350 cubic yards of material (primarily bedrock) from an area 25-ft in width by 225-ft in length to an average depth of 5-ft, located immediately in front of the existing dock. Work would be completed over a five-day period, utilizing a low-impact hydraulic Xentric Ripping head on a LS 800 barge-mounted excavator. Dredge material would be excavated and placed on a split hull dump barge or flat deck barge, and would dewater naturally in-transit to the dredge disposal site, located in St. Herman Bay, approximately 1-mile from the project area (see enclosure). The material barge would be pushed by a tugboat en-route to the dredge disposal site; upon arrival at the dredge disposal site, material would either be dumped (if using the split hull dump barge) or mechanically removed with clamshell excavator (if using the flat deck barge).   • POA-2013-273, Ward Cove

    Alaska Department of Transportation and Public Facilities (ADOT&PF), Southcoast Region. The Applicant's stated purpose is to construct a new ship berthing complex and ferry terminal as part of the Alaska Marine Highway System (AMHS) Ward Cove Marine Facility Project. The Ward Cove berthing facility is intended to provide a functional replacement for the existing AMHS South Berth facility in Ketchikan and to consolidate all Ketchikan based AMHS management and engineering functions to the Ward Cove property.
