Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

    Expiration date: 11/7/2023

    Silver Bay Seafoods states the purpose is to construct an 80 foot x l20 foot, two-story marine services building and to repair a failing wood retaining wall and repair the piling for an existing dock. The project site is located within Section 6 T. 28 S., R. 19 E., Seward Meridian; USGS Quad Map Kodiak D-2; Latitude 57.7900º N., Longitude 152.3944º W.; in Kodiak, Alaska. PROPOSED WORK: To discharge 9000 cubic yards of shot rock, 150 cubic yards of rip rap, and 214 cubic yards of concrete fill material into 0.33-acres of intertidal waters (below the high tide line and mean high water mark) in order to construct a 80-foot x 120 foot marine services building, repair a failing wood retaining wall, and repair (27) 12-inch steel piles. All work would be performed in accordance with the enclosed plan (sheets 1-9), dated December 19, 2022.     Wolf Constructors Inc. P.O. Box 11118 Bozeman, MT 59719 states the purpose is to placer mine Long Creek to capture the findings of gold on their registered claim in ADL 800204. The proposed work would involve placer mining along a portion of Long Creek in ADL 800204 for a period of 5-years. The project would impact approximately 12-acres along Long Creek. Exploration would be conducted solely through drilling. The project would involve mechanical placer mining, mechanical dredging, and suction dredging. Dredging is expected to occur at various locations in the stream within the registered claim. Also, a 25 ft x 8 ft cobble pad would be constructed at the site for the placement of the trommel. The entire work area would be bermed to isolate the work area from the stream. Berms would be set back from the stream by 2 ft. A settlement pond and a recirculate pond would also be constructed to support the operation. The recirculate pond would be gravity fed back to Long Creek. Water supply for the operation would be provided through the construction of a water diversion that would draw water from Long Creek when needed. A 12-inch head gate with fish screen (1/8 inch spacing) would be used at the entrance of the water diversion. Water would be returned back to Long Creek from the recirculate pond via an ADS pipe French drain that will also have a fish screen (1/8 inch spacing). The course of Long Creek would not be altered by the water diversion or project. All disturbed areas will be reclaimed and revegetated after mining is completed at the site. All work would be performed in accordance with the enclosed design plans (sheets 1-3). The project site is located approximately 11 miles northwest of Petersville in Section 14, Township 28 North, Range 9 West, Latitude 62.515969° North, Longitude - 150.904408° West, Matanuska-Susitna Borough, Alaska.     Haines Borough, 103 Third Avenue South, Haines, AK 99827 states that the purpose is to maintain existing freight and cargo capacities at Lutak Dock so the Haines area has reliable, safe, and economical barge service for the foreseeable future. The proposed project would include the following components below the High Tide Line (HTL; approximate elevation +21.2 feet above the 0.0 foot contour) and the mean high water (MHW; approximate elevation +15.78 feet above the 0.0 foot contour) line in waters of the United States, including navigable waters. The project site is located within Section 10, T. 30 S., R. 59 E., Copper River Meridian; USGS Quad Map Skagway B-2; Latitude 59.2827° N, Longitude 135.4660° W; within Lutak Inlet at the Lutak Dock, in Haines, Alaska.     Expiration date: 8/28/2023

    Jeff Savage, Offshore Systems, Inc., 12019 76th Place NE, Kirkland, WA 98034 states the purpose is to expand the pad area at the existing marine cargo dock in order to increase cargo-handling efficiency and safety, and for staging additional cargo volume. The applicant proposes to discharge 17,000 cubic yards of shot rock fill and riprap into 0.65-acres below the high tide line (HTL; 5.2 feet above the 0.0-foot contour) of Captains Bay, a navigable water of the United States. The proposed work includes the excavation and dredging of the existing riprap located along the fill slope. Excavated rock would be temporarily staged on the pad. Approximately 850 cubic yards of existing riprap would be salvaged and used in the proposed fill slope. The proposed work is expected to take place between September and November 2023. The placement of rock fill material would be completed using standard heavy equipment including end-dumps, side-dumps, excavators, dozers, and compactors. Riprap placement would be completed using excavators and cranes. The excavation and placement of rock fill below the HTL would be done during low tidal stages as practicable. The project site is located within Section 21, T. 73 S., R. 118 W., Seward Meridian; USGS Quad Map Unalaska C-2 SW; Latitude 53.8414° N, Longitude 166.5826° W; at the existing OSI Dock Facility, Mile 4.5 of Captains Bay Road, Dutch Harbor, Unalaska, Alaska.     John Webby, 13807 18th Avenue SW; Burien, WA 98166; email: john.webby@comcast.net; telephone: (206) 331-0715 states the purpose is to build a new single-family residence. The seawall and placement of fill below the Tongass Narrows High Tide Line (HTL) is necessary because the buildable upland is very limited due to the geometry and topography of the lot. To fill 0.046-acres below the HTL of Tongass Narrows to construct a building pad (370 cubic yards of fill) and a concrete seawall (115 cubic yards) for the new single-family residence on Lot 12, USS 2804. The proposed concrete wall would be 200 feet along the waterfront and terminate into the upland area. The seawall bottom would be at Mean High Water (MHW) line and the top at 23 feet elevation. Approximately 3,000 cubic yards of unsuitable soil and 9,400 cubic yards of rock would be excavated from the lot’s uplands. The total fill would be approximately 600 cubic yards and would come from blasting the existing rock on site. A small ramp would be constructed to allow access to the sandy beach below for recreational use. The project site is located within Section 29, T. 74 S., R. 90 E., Copper River Meridian; USGS Quad Map Ketchikan B-6; Latitude 55.4242° N, Longitude 131.7809° W; Rocky Point Subdivision USS 2804, Lot 12; 10309 Rocky Point Drive, 3.5 miles northwest of Ward Cove, near Ketchikan, Alaska.
