Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

    Expiration date: 5/15/2023

    Mr. Christian Buschmann, P.O. Box 898, Petersburg, Alaska 99833, states the purpose is to construct roadway access and utilities for a residential and fishing storage development, as well as construct pads for vacation rental cabins, a private residence, and a fishing gear storage warehouse and shed. Discharge up to 25,800 cubic yards of shot rock fill material into a total of 3.14 acres of wetlands in order to construct a road and two building pads. The road would be 1,250 feet long with a top width of 17 feet and a bottom width varying from 30 to 40 feet wide. Within the road, a 6-inch diameter HDPE waterline would be placed. Power poles would be placed along the road for above ground power utilities. Up to a total of 2.7 cubic yards of crushed rock would be placed with nine poles for stabilization. An approximately 194 foot long by 87 foot wide fill pad would be constructed on the south side of the road for the construction of four vacation rental cabins. At the end of the road, an approximately 400 foot long by 100 foot wide fill pad would be constructed for the applicant’s residence, warehouse, and shed. At the north end of this pad, the northwest corner would be extended for the house (see project drawings for dimensions). To construct the proposed road and fill pads which will house the water line, four to eight feet of muskeg overlaying hard pan clay would be removed and replaced with shot rock. For those filled areas which do not house the water line, soil stabilizing fabric would be placed over the muskeg and up to three feet of shot rock would be placed on top of the fabric. The road would cross four streams and culverts would be installed for each crossing. Each culvert would be approximately 46 foot long and width would vary depending on the width of the stream. The inlets and outlets of the culverts would have riprap stream channel liners installed within the footprint of the road dimensions. All work would be performed in accordance with the enclosed plan (sheets 1-5), dated March 2023.     Michele Elfers, City and Borough of Juneau (CBJ) Parks and Recreation Department (PRD), 155 S. Seward Street, Juneau, Alaska 99801, michele.elfers@juneau.gov, states the purpose is to develop off road vehicle (ORV) recreation opportunities to help foster a sense of community and create job opportunities in an underserved sector of the outdoor recreation community, as well as provide economic benefits for the community. The applicant proposes to discharge a total of 5,365 cubic yards of fill material into 1.25-acres of wetlands for the construction of an ORV park. The proposed project would include approximately five miles of riding trails, a parking and entry area, a mud pit feature, and a cross country riding area. Up to 4,546 cubic yards of shot rock, geotextile, and logs would be discharged into 1.07-acre of wetlands to construct the trails. Trails would be eight feet wide with occasional wider turnout areas. Turnout areas would be located in upland areas only. Where conditions permit, a corduroy building technique would be employed, utilizing trees cleared from the site as a base. The trail would clear-span one stream. Up to 438 cubic yards of shot rock borrow, clay, mud, and logs would be discharged into 0.12-acre of wetlands to construct a 110-foot by 50-foot mud pit with a sediment trap. The mud pit would consist of two mud bogs and entry and exit trails, which would be constructed utilizing a clay liner, 12-inches of shot rock, and saturated, non-organic mud. A sediment trap on the downhill side would be constructed as a detention area with a 6-inch shot rock base to collect and settle sediment. Up to 381 cubic yards of shot rock and geotextile would be discharged into 0.05-acre of wetlands to construct a 1.5-acre parking area at the entrance to the site. The parking lot would consist of a gravel lot with 4-foot of rock fill in the wetland. The 5,000 square foot cross country riding area would be located in a previously logged area at the north end of the site. Trails would not be constructed, and fill would not be added in this area. All work would be performed in accordance with the enclosed plan (sheets 1-11), dated March 11, 2023.     City of Valdez; P.O. Box 307, Valdez, Alaska 99686, states the purpose is streambank stabilization from erosion and flood control. Discharge of 22,000 cubic yards of rip rap and 37,200 cubic yards of alluvial fill material into 7-acres into riverine waters below the Ordinary High Water mark of Glacier Stream for construction of six spur dikes and an access ramp. Specifically, the work includes construction of spur dike one approximately 650-foot-long by 132-foot-wide, spur dike two approximately 430-foot-long by 108-foot-wide, spur dike three approximately 500-foot-long by 108-foot-wide, spur dike four 400-foot-long by 108-foot-wide, spur dike five 365-foot-long by 108-foot-wide, spur dike six 370-foot-long by 108-foot-wide, and an access ramp 300-foot-long by 75-foot-wide.     Juneau International Airport, City and Borough of Juneau, 1873 Shell Simmons Drive, Suite 200, Juneau, AK 99801, states the purpose is to install additional approach lighting systems to improve aircraft alignment with the runway and improve pilot transition to visual references for landing at JNU at night and during poor weather conditions and construct a Fuel Farm Access Road to create safer traffic conditions by keeping fuel supply trucks off public streets.     Matanuska Susitna Borough (MSB), 350 East Dahlia Avenue, Palmer, AK 99645, states the purpose is to reconstruct the roadway to collector road standards from the Parks Highway to South Caswell Loop Road. Permanently discharge up to 3,609 cubic yards of fill material into 1.1 acres of waters of the U.S., including wetlands, and temporarily discharge up to 441 cubic yards of fill material into 0.1-acre of waters of the U.S., including wetlands in order to make improvements to Hidden Hills Road. A total of 3,313 cubic yards of Type B or better fill material would be discharged into wetlands to improve the road subgrade and widen lanes, replace, repair, or install roadside hardware, adjust or relocate utilities, and make drainage improvements. Up to 296 cubic yards of stream substrate fill would be permanently placed below the ordinary high water mark (OHW) of an unnamed tributary to Caswell Creek in order to replace the existing culverts with an eight foot box culvert and armor the downstream channel. Up to 441 cubic yards of gravel fill would be temporarily discharged below the OHW in order to install a temporary culvert to maintain stream connectivity during construction.
