Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2011-831

    Expiration date: 1/9/2017

    Joseph M. Smith's (Salmon Creek Development) stated purpose is to deepen the entrance channel and dock face at the Salmon Creek barge facility. The project site is located within Section 9 and 16, T. 41 S., R. 67 E., Copper River Meridian; USGS Quad Map Juneau B-2; Latitude 58.325032º N., Longitude 134.470568º W.; within Gastineau Channel, in Juneau, Alaska. PROPOSED WORK: The applicant requests authorization for the following work in and over navigable waters of the United States: Dredge 55,000 cubic yards of marine sediment from 6.5 acres below the mean high water mark (approximate elevation +15.4 feet above the 0.0 foot contour) in Gastineau Channel at the Salmon Creek barge facility to deepen the dock face and entrance channel for the navigation of deep draft barges. The applicant is proposing to perform the dredging using conventional clamshell dredging techniques to a proposed depth of -15 to -20 feet MLLW. Dredge material would be deposited in a center-dump barge, with return flow, for transport to the disposal site. Disposal of the dredged material is proposed through the discharge over 7.5 acres of the seafloor at a location approximately 0.6 miles southeast of the proposed dredging site at Latitude 58.318396º N., Longitude 134.460761º W. within Gastineau Channel.     The City of Kodiak wants to improve pedestrian facilities along Shelikoff Street and to reduce pedestrian/vehicle conflicts. The project site is located within Section 31, T. 27 S., R. 19 W., Seward Meridian; USGS Quad Map Kodiak D-2; Latitude 57.7877º N., Longitude 152.4123º W.; St. Paul Harbor, Kodiak, AlaskaThe applicant proposes to conduct the following work below the mean high water mark of Saint Paul Harbor, which is a navigable water of the Unites States (MHWM): Dredge up to 310.8 cubic yards of poorly graded gravel (7-10% silt and sand) and rip rap from 0.29 acres and discharge 3,410cubic yards of silts, sands, gravels, and riprap into 0.27 acres of Saint Paul Harbor, which is a navigable water of the United States (U.S.) in order to construct a solid fill bulkhead to support a parking lot. The solid fill portion of the dock would be constructed in lifts by wrapping rock and dredged material in geotextile fabric. The face of the geotextile wrapped fill would be protected by a timber bulkhead wall. The timber bulkhead wall would be installed through excavation rather than pile driving.     The revised proposed project’s purpose, as stated by the applicant, is to expand the Airfield Maintenance (AFM) Storage Yard to provide additional storage capacity for dry goods, material, and equipment that AFM uses to maintain both the LHD and international airport. A secondary benefit would be to provide the base for future additional aircraft parking, as shown in the LHD Master Plan. Future projects, including runway and taxiway reconstruction projects, will generate a significant amount of usable material, including gravel and recycled asphalt (RAP) that is a good resource for both AFM and future construction projects. These materials would be stored on the proposed expanded pad. The ADOT&PF will submit a new alternatives analysis, as the listed alternatives in the original public notice were evaluated with the previous project purpose in mind. All other information contained in the previous notice remains the same.     Mr. Stephen Ribuffo's (Municipality of Anchorage Port of Anchorage) stated purpose is to improve the navigational conditions for Terminal 3 and to create a safe and stable area that will support Port operations while also maximizing the area available for future use on the North Extension. The project site is located within Section 7, T. 13 N., R. 3 W., Seward Meridian; USGS Quad Map Anchorage A-8; Latitude 61.245461º N., Longitude 149.882944º W.; in Anchorage, Alaska. PROPOSED WORK: The Municipality of Anchorage through its Port of Anchorage Department (POA) proposes the reconfiguration and realignment of the shoreline within the North Extension (area north of the existing general cargo Terminal 3 that was authorized under Department of the Army (DA) permit POA-2003-502-2). The North Extension Stabilization (NES) project would be completed in two distinct steps, NES-Step 1 and NES-Step 2, separated by multiple years. This Public Notice addresses NES-Step 1.     Mr. Steve Connelly'S (Eklutna, Inc) stated purpose is to remove the functionally obsolete Lower Eklutna River Dam, which would restore some natural stream functions currently inhibited by the dam’s presence. The project site is located within Sections 29 and 30, T. 16 N., R. 1 E., Seward Meridian; USGS Quad Map Anchorage B-7; Latitude 61.44954º N., Longitude 149.32979º W.; Municipality of Anchorage; near Eagle River, Alaska. The impacts from the proposed project would be 2400 cubic yards (CY) of temporary fill into 0.74-acre of waters of the U.S. (WOUS) for the various work areas, 186.1 CY of temporary diversion structures, and 21,000 CY of relocated sediment downstream of the dam.
