Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2013-541, Campbell Creek

    JL Properties, Inc's stated purpose is to develop Alaska’s first outlet mall and provide a new class of shopping within the state. The site would offer multiple retail outlets from either sole manufactures or wholesalers representing an array of merchants, in addition to cafes and restaurants. The applicant proposes to develop 24.82 acres into an outlet mall with attendant features such as parking and landscaping. The project would require the placement of 480,000 cubic yards of Type II/IIA classified fill into 19.94 acres of wetlands.   • POA-1990-346-M6, Naknek River

    Expiration date: 12/23/2013

    Trident Seafood Corporation's stated purpose is to support existing seafood processing operations by providing additional storage and staging areas. Proposed Work is to construct two separate wood-decked and steel pile-supported dock additions to their existing seafood processing facility. More specifically, a 60-foot by 174-foot dock would be supported by 55 steel pilings and constructed on state parcel ATS 836; and a 40-foot by 100-foot dock would be supported by 90 steel pilings and constructed on state parcel ATS 1137. In total, the two docks would cover an area of 18,440 square feet or 0.423-acre. An impact hammer would drive the steel pilings into the river bank during the lowest tidal stages between May and September of 2014. All work would be performed in accordance with the enclosed plan (sheets 1-6), dated October 21, 2013.   • POA-1994-1014, Orca Inlet

    Expiration date: 12/16/2013

    The Native Village of Eyak’s stated purpose is to construct an Oil Spill Response (OSR) Facility at Shepard Point to enhance current OSR capabilities, near Cordova, Alaska. The facility would be able to receive oil spill equipment from any location through a transportation sequence of either air ‐to‐ground‐to‐response–vessel or cargo–vessel ‐to‐response– vessel sequence. The facility would also accommodate existing and foreseeable future oil spill response and cargo vessels with deeper drafts than the current capabilities of existing facilities in the area and provide an adequate staging area contiguous to the proposed dock.   • POA-2013-457, Eek River

    Expiration date: 11/25/2013

    City of Eek stated purpose is to construct a new permitted Class Ill solid waste facility in accordance with 18 AAC 60, as regulated by Alaska Department of Environmental Conservation (ADEC). The project also includes construction of a 1400-foot long by 12-foot wide boardwalk to access the new landfill. The total impact of fill material placed into jurisdictional wetlands is 8.416 acres. Proposed Work: New Class Ill Landfill: The applicant proposes to open a new permitted landfill that will serve the community for the next 20 years. Approximately 3.0 acres of wetlands will be permanently impacted by the discharge of fill material. The existing dump site has exceeded its useful life and poses potential health, safety, and environmental hazards. Trash is currently dumped in an uncontrolled area adjacent to a 3-acre pond. As a result, trash is accumulating in the pond and could potentially contaminate surface and ground water. Contaminants can affect public health and aquatic and terrestrial plants and animals coming in contact with the water. Additionally, there is no heavy equipment present at the dump site; therefore, the waste is not compacted or covered and it attracts wildlife including ravens and foxes. Wildlife may contract diseases from the exposed waste and may also spread it. Animals also become accustomed to this food sources and to human presence, increasing the potential for human-wildlife encounters that can lead to physical attack or disease transmission.   • POA-2013-538, Putuligayuk River

    Expiration date: 12/9/2013

    Alaska Industrial Development and Export Authority's stated purpose is to reduce fuel costs and improve air quality within the FNSB (Fairbanks North Star Borough) by making a supply of liquefied natural gas available on the North Slope of Alaska for overland transportation to the FNSB to meet residential, commercial, and industrial demands. Proposed work is to construct a liquefied natural gas facility. 14.97 acres of permafrost tundra wetlands would be filled with 150,800 cubic yards of local source gravel material. Fill would be discharged into the wetlands for construction of an operations pad, access road and misc. small fills areas to support infrastructure and operations.
