Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

    APPLICANT: Mr. John Barnett (Alaska Department of Transportation and Public Facilities). The applicant’s stated purpose is to address: • Highway deficiencies between Milepost 3.5 and Milepost 25.3 • Bridge deficiencies • Highway instability and temporary closures caused by debris and water flooding • Recreational access deficiencies. PROPOSED WORK: The applicant requests authorization for the following work in waters of the United States: Discharge 131,236 cubic yards of clean gravel, sand, and rock fill material into 22 acres of palustrine wetlands and discharge 28,995.9 cubic yards of clean gravel, sand, and rock fill material into 4 acres below the Ordinary High Water Mark (OHW) of the Chilkat River to realign and widen the Haines Highway. Work would include the installation of 13 corrugated metal pipe culverts ranging in size from 48 inch to 3.5 feet diameter, and 13 arch pipes ranging in size from 81-inch by 59-inch to 12 feet 7 inch by 8 feet 4 inch into 1,857 linear feet of stream (0.3 acres) below the OHW. All work would be performed in accordance with the plan (sheets 1-41), dated January 2017. SPECIAL AREA DESIGNATION: The project is located within the Alaska Chilkat Bald Eagle Preserve.     Expiration date: 3/24/2017

    Mr. Kent Halvorson (Boyer Towing) stated the purpose is to improve site access and develop the property for the owner’s tug and barge business. The project site is located within Section 34, T. 74 S., R. 90 E., Copper River Meridian; USGS Quad Map Ketchikan B-6; Latitude 55.4039º N., Longitude 131.7192º W.; in Ketchikan, Alaska. PROPOSED WORK: Boyer Towing is proposing to install a mooring/loading facility. The proposed project would install (3) 30-inch steel pilings, (1) 24-inch steel piling, (10) 16-inch steel pilings, a mooring dolphin composed of a 30-inch vertical piling, a 6-foot by 70-foot aluminum gangway and a 20-foot by 20-foot floating dock. The pilings would be installed by vibratory hammer to the extent possible. The proposed project would also discharge 1500 cubic yards (CY) of shot rock and 200 cubic yards of armor stone behind a 30-foot long concrete abutment for an impact of 0.02-acre of waters of the U.S. to allow for the facility to be at the needed operation depth of -15-foot Mean Lower Low Water (MLLW) without dredging.   • POA-1989-324-M8

    Expiration date: 3/3/2017

    The applicant has revised their project to include the discharge of an additional 4,400 cubic yards of shot rock and 900 cubic yards of armor rock into 0.3 acre below the HTL and MHWM of Dutch Harbor (see Sheet 2 of 4). This change would result in an overall discharge of 41,900 cubic yards of shot rock and 9,300 cubic yards armor rock into 3.0 acres below the HTL and MHWM of Dutch Harbor. Additionally, the applicant proposes to utilize fill material from an adjacent upland quarry. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated May 18, 2016, and February 2017. The project site is located at the UMC Dock within Section 35, T. 72 S., R. 118 W., Seward Meridian; USGS Quad Map Unalaska C-2; Latitude 53.9031º N., Longitude 166.5277º W.; southwest of UMC existing Dock Position VII, water ward of Ballyhoo Road, in Unalaska, Alaska.     Ms. Deborah Heebner (Hilcorp Alaska, LLC) stated purpose is to expand Milne Point Unit (MPU) F Pad to provide space for up to eight additional development wells. The project site is located in Milne Point Unit, within Section 6, T. 13 N., R. 10 E., Umiat Meridian; USGS Quad Map Beechey Point C-5; Latitude 70.507606º N., Longitude -149.660607º W.; North Slope Borough, Alaska. PROPOSED WORK: The placement of 43,500 cubic yards (cy) of gravel fill material into 3.2 acres of jurisdictional Palustrine emergent wetlands for the expansion of F Pad and construction of up to 8 additional wells. Space is also needed to install associated infrastructure to facilitate production activities from the new development wells at MPU F Pad.     PURPOSE: The United States Air Force's stated purpose is to provide shelter for aircraft maintenance. PROPOSED WORK: Discharge 4,633 cubic yards (cys) of fill material into 1 acre of wetlands to construct a Hanger Propulsion Dispatch building and parking area. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated February 7, 2017.
