Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

Per Brautaset, with Kloosterboer Dutch Harbor, LLC. 2025 First Avenue, Seattle, Washington 98121, states that the project purpose is to provide for increased capacity of their existing dock (used for loading, off-loading and cold storage of seafood products) and a greater margin of safety for mooring larger vessels that currently overhang the north end of the dock. Dredging would allow deeper draft vessels to utilize the inside and outside faces of the south dock.     Mr. Michael Rogers (Bristol Bay Area Health Corporation) stated the purpose is to upgrade the water treatment plant facilities to capture solids from the waste filter backwash water from the hospital water treatment plant and retain them until they are removed periodically for disposal at the city landfill. The project site is located at Latitude 58.996945º N., Longitude -158.541389º W.; 6000 Kanakanak Road, City of Dillingham, Alaska. The applicant proposes to construct an earthen pond for receiving waste filter backwash water from the hospital water treatment plant, filling an area of 1.12-acres with approximately 4600-cubic yards of clean fill from the local borrow pit or shot rock pit (both of which are used by the local municipality and the State of Alaska in road and airport projects). All work would be performed in accordance with the enclosed plan (sheets 1-10), dated December 27, 2017.     Applicant’s stated purpose is to improve mobility and safety for people and freight, and enhance access management along the Parks Highway. The project site is located within Sections 7, 8, 9, 17, and 18, T. 17 N., R. 2 W., and Section 12, T. 17 N., R. 3 W., Seward Meridian, project beginning at Latitude 61.5792º N., Longitude 149.6448º W., project ending at Latitude 61.5775° N., Longitude 149.7277° W., Parks Highway MP 48.8-52.3, west of Wasilla, Alaska. ADOT&PF is proposing to permanently discharge up to 771,510 cubic yards (cy) of Type A, B, and C material into 39.2 acres of waters of the U.S., including wetlands, and relocate up to 5,000 linear feet of stream for the installation and replacement of 61 culverts throughout the project site. In addition to the permanent fill activities, ADOT&PF is also proposing to temporarily fill up to 5.9 acres of wetlands to facilitate the construction. The impacts to waters of the U.S., including wetlands, is for the upgrading of four miles of the existing Sterling Highway and the construction of 10 new miles of road north of Cooper Landing, Alaska. In achieving this transportation purpose, Alaska Department of Transportation & Public Facilities (AKDOT&PF) and Federal Highway Administration (FHWA) recognize the importance of protecting the Kenai River corridor. The Project site is located within Sections 19, 25-30, 36, T. 5 N., R. 3 W., Sections 23, 24, 26-32, T. 5 N., R. 4 W., Sections 35, 36, T. 5 N., R. 5 W., Seward Meridian; USGS Quad Maps Seward B-8, Seward C-8, and Kenai B-1; Latitude 60.51º N., Longitude 149.90º W.; near Cooper Landing, Alaska. SPECIAL AREA DESIGNATION: The project is located within the Chugach National Forest and the Kenai National Wildlife Refuge. The project would produce 3-phase hydrocarbons (oil, gas, and water) which would be carried by pipeline to the ACF at CD1 for processing. Sales-quality crude oil produced at the ACF would be transported from CD1 via the existing Alpine Sales Oil Pipeline and Kuparuk Pipeline to the Trans-Alaska Pipeline System (TAPS) for shipment to market. The entirety of the project is located on the Arctic Coastal Plain of Alaska in the National Petroleum Reserve–Alaska near the Beaufort Sea and west of the Colville River, approximately 12 miles northwest of Nuiqsut, Alaska, within the following areas: • Sections 1, 11, 12, 14, 22, 23, 27, 32-34 of Township (T) 10 North (N), Range (R) 2 East (E), Umiat Meridian (UM); • Section 6 of T. 10 N., R. 3 E., UM; • Sections 24-28, 31-33 of T. 11 N., R. 3 E., UM; • Sections 12-19 of T. 11 N., R. 4 E., UM; • Sections 5-7 of T. 11 N., R. 5 E., UM; • U.S. Geological Survey Quadrangle Maps Harrison Bay A-2 and Harrison Bay A-3. 70.1730° North, -150.6934° West (GMT2 Drill Pad); Proposed Work: CPAI proposes the placement of 674,300 cubic yards (cy) of clean fill material into 78.1 acres, of which 77.9 acres are WOUS, including wetlands (see Table 1 of Public Notice), to construct: ▪ An 8.2-mile gravel access road (62.8 acres total; 62.6 acres in WOUS); ▪ A drill pad with 48-well capacity at GMT2 (14.0 acres in WOUS); ▪ Three vehicle pullout pads (0.4 acre each in WOUS) for safety and subsistence activity access; and ▪ Vertical Support Members (VSM) for 8.6-mile pipeline from GMT1 to GMT2 (total fill footprint of 0.1 acre in WOUS).
