Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2015-25

    Expiration date: 12/3/2018

    PURPOSE: The applicant, Oil search, stated purpose is to safely produce commercial quantities of liquid hydrocarbons in OSA’s State of Alaska and Arctic Slope Regional Corporation (ASRC) oil and gas leasehold by operating from a site east of the Colville River Delta; to process hydrocarbons on or near the drill sites; and to transport sales quality oil through a new export pipeline to the Kuparuk sales oil pipeline, and then to the Trans-Alaska Pipeline Service (TAPS). A secondary purpose of the Project is to further delineate geological features and hydrocarbon accumulations in OSA's leasehold utilizing the proposed infrastructure. LOCATION: The Project would be located in the North Slope Borough (NSB) in the Pikka Unit between Kuparuk and the Colville River Unit development (Alpine), east of the Colville River, approximately 6.5 miles northwest of the Village of Nuiqsut. PERMIT HISTORY: In June 15, 2015 the applicant originally proposed to impact 288 acres of waters of the United States (U.S.), including wetlands (WOUS). In July 2017, the applicant submitted a revised permit application modifying the width of the access road from 38 to 35 feet wide. This change resulted in a reduction of impacts to WOUS of 16.4 acres to 271.6 acres. This reduction was not analyzed in the DEIS due to the timing of receipt of these changes, although this change was describe in the original Public Notice for the permit in September 2017. In response to comments on the DEIS, the applicant (OSA) further modified their proposal as described above. These changes in Project description decreased the overall Project footprint by another 10.3 acres of WOUS to 261.3 acres. This is a 27 acre reduction in impacts to WOUS from the original application dated June 15, 2015. A difference in acreages from the Final Environmental Impact Statement (FEIS) and this PN is due to the method in which impacts were calculated. To determine total impacts to WOUS for the proposed project the applicant used more detailed methods than those necessary for the FEIS. This is the second Public Notice period for the Nanushuk Development Project permit application. It includes the final project proposal and a new Compensatory Mitigation Plan. All comments should reach this office no later than the expiration date of this Public Notice to become part of the record and be considered in the decision.     Mr. Gordon Brower, with North Slope Borough (NSB), PO Box 69, Utqiaġvik, Alaska 99723, (907) 852-0320, states that the project purpose is to develop a regional material site providing gravel for industry. Work being proposed includes to mechanically clear a total of 74.09 acres of Palustrine emergent wetlands to develop a gravel mine site adjacent to the existing Mine Site F. This would be accomplished in two separate phases, the second phase would not be mechanically land cleared until the first phase is depleted. The project site is located within Section 12, T. 11 N., R. 8 E., Umiat Meridian; USGS Quad Map Beechey Point B-5; Latitude 70.3183º N., Longitude 149.9801º W.; approximately 25 miles east of Nuiqsut, Alaska.     Expiration date: 11/23/2018

    The City of Kake, Post Office Box 500, Kake, Alaska 907-785-3804, purposes to upgrade and maintain access to the existing seaplane float while providing wave protection for the seaplane float and public safety. Work being proposed includes improvements to the Kake City Dock in Keku Straight in Kake, Alaska to maintain access to the existing seaplane float while providing wave protection for the seaplane float. The existing City Dock will be demolished and replaced with a reconfigured, upgraded facility.     Expiration date: 11/13/2018

    Mr. Brett Nelson, with DOT&PF, 2301 Peger Road, Fairbanks, AK 99709, states that the project purpose is to provide a safer runway for the community of Kotlik. Work being proposed includes the placement of 37,650 cubic yards of clean fill material permanently impacting 3.0 acres of wetlands and temporarily impacting 11.0 acres of wetlands to: provide a staging area, waste disposal area, temporary access road, rehabilitate the segmented circle road and pad, and replace a culvert. All work would be performed in accordance with the enclosed plan (sheets 1-2), dated July 30, 2018.     Expiration date: 10/24/2018

    John Barnett, with the Alaska Department of Transportation and Public Facilities, 6860 Glacier Highway, Juneau, Alaska 99811, states that the project purpose is to provide safe and efficient berthing, mooring and transfer of vehicles and pedestrians for existing and proposed new ferry vessels. The facility has been designed to accommodate multiple vessels simultaneously.Work being proposed involves the dredging of 9,000 cubic yards of marine sediment from 1.2 acres below the mean high water mark (MHW, approximate elevation +15.8 feet above the 0.0 foot contour) of Lutak Inlet to a depth of –30 feet below mean lower low water (0.0 feet) to provide sufficient water depth to accommodate end loading of AMHS ferry vessels at all tidal ranges. The dredged material is proposed to be disposed of by discharge over 18 acres of the seafloor in water approximately 900 feet deep, at Latitude 59.2894º N., Longitude 135.3833º W., approximately three miles northeast of the proposed dredging site, in Taiya Inlet (see Sheet 11 of 11). Upon completion of dredging, 7,000 cubic yards of riprap would be discharged into 1.2 acres below the high tide line (HTL, approximate elevation +21.2 feet above the 0.0 foot contour) and MHW of Lutak Inlet for slope protection of new berths.
