Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2000-299

    Expiration date: 8/21/2017

    Lt. Col. Jeremiah Hammill (United States Air Force (USAF)) stated the purpose is to repair the seawall at Cape Lisburne Long Range Radar Site (LRRS) to allow for safe aircraft operating conditions during takeoff and landing. The project site is located within Section 34-36, T. 6 S., R. 60 W., Umiat Meridian; USGS Quad Map Point Hope D-2; Latitude 68.87355º N., Longitude 166.11225º W.; approximately 40 miles northeast of Point Hope, Alaska. The applicant proposes to discharge 100,000-160,000 cubic yards (cy) of fill material into a 9.4 acre area below mean high water (MHW) during the reinforcement of a seawall protecting a remote airstrip. The material discharged below MHW would consist of smaller rock, sand, and gravel removed from the seawall. The project is anticipated to last a duration of three years, inclusive of both elements of the project (quarry rock extraction operations and the actual seawall repair).     Expiration date: 8/14/2017

    Ms. Dunham (Harvest Alaska, LLC) stated the purpose is to construct a new oil pipeline to move crude oil from the west side of Cook Inlet to the east side via pipeline. The project site is located within Sections 21 – 26 and 28, T. 11 N., R. 12 W., Seward Meridian; USGS Quad Map Tyonek A-4; Latitude 61.0210º N., Longitude 151.3784º W.; near Tyonek, Alaska. PROPOSED WORK: The applicant is proposing to discharge 11,400 cubic yards (cy) of native material into 2.94 acres of wetlands for the construction of 9,300 linear feet of pipeline in waters of the US, including wetlands. The proposed trench would be 13.75 feet wide and up to 6 feet deep. The material excavated from the trench would be temporarily side cast onto frozen ground (work is proposed to be conducted during the winter), and returned to the trench, once the 10 inch diameter pipeline and fiber optic cable are installed. The proposed project would consist of trenching, side casting, and backfilling of the trench during the winter. All impacts to waters of the US, including wetlands would be temporary in nature.     Ethan Berto stated the purpose is to provide a pad for the construction of a residential dwelling. The project site is located within Section 33, T. 76 S., R. 91 E., Copper River Meridian; USGS Quad Map Ketchikan B-5; Latitude 55.3039º N., Longitude 131.5623º W.; proceed south from the Ketchikan Airport on the Tongass Highway seven miles to the project site; near Ketchikan, Alaska. PROPOSED WORK: Construct a 2,325 square-foot (0.05-acre), roughly 86-foot by 67-foot, fill pad below the high tide line that would consist of 630 cubic yards of shot rock and 60 cubic yards of rip rap.     Mr. Michael Alfano (Alaska’s Best Water) stated the purpose is to consolidate the facilities of Alaska’s Best Water & Coffee (ABWC) and its recent acquisition, Alaska Pure Water, at a single location that provides sufficient size to house the entire operation, has ready access to major transportation corridors, is in a central location, and zoned for industrial use. The project site is located within Section 1, T. 12 N., R. 4 W., Seward Meridian; USGS Quad Anchorage A-8; Latitude 61.1603º N., Longitude 149.9150º W.; Tract A-1, Block 1, Industrial Park 6800; Parcel Number 012-581-17-000; in Anchorage, Alaska. PROPOSED WORK: The proposed project would excavate 11,374 cubic yards of wetlands, including grubbing of 2,274 cubic yards of surface organics, vegetation, and underlying peat; and discharge 18,200 cubic yards of classified structural fill (well-graded sand and gravel) on 1.41 acres of wetlands to create a pad. The pad would be for the construction of a 25,352 square foot office and warehouse building, an 8,000 square foot future store expansion area, 3,000 square foot open storage area, driveway access from Alaska’s Best Place and Ressell Avenue, parking for customers and delivery trucks and areas designated for stormwater management and vegetation screening. All work would be performed in accordance with the enclosed plan (sheets 1-5), dated July 5, 2017.     Expiration date: 8/8/2017

    Peak Gold, LLC's stated purpose is to define the potential extent of mineralization and associated economic value of that mineralization, on lands predominantly owned by the Tetlin Tribal Council. The duration of the project is dependent on drilling results and delineation of economic mineral resources and is anticipated to continue for about 5 years. LOCATION: The project site is located within Section 7, T. 16 N., R. 13 E., Copper River Meridian; USGS Quad Map Tanacross A-4; Latitude 63.18259º N., Longitude 142.8923º W.; near Tok, Alaska. PROPOSED WORK: Discharge of fill material into approximately 5 acres of scrub-shrub and wetlands for the construction of permanent and temporary access roads and drill pads for mineral exploration. The project boundary encompasses over 32,000 acres with about 76 percent of the areas classified as uplands; the majority of wetlands occurring in valley bottoms or north-facing slopes with permafrost. The majority of the drilling areas are proposed in uplands. Some drilling pads would require access through wetlands typically on north-facing slopes. Construction of access roads and drill pads in wetlands would be done during the winter months to minimize disturbance. Generally, reclamation on wetland sites would be initiated immediately following exploration drilling and the ground is still frozen. All work would be performed in accordance with the enclosed plan (sheets 1-8), dated June 22, 2017. Comments on the described work, with the reference number, should reach this office no later than the expiration date of this Public Notice to become part of the record and be considered in the decision.
