Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

  • POA-2016-402

    Expiration date: 5/1/2017

    Efficient Coastal Resources stated the purpose is to construct a 198-acre aquaculture farm. The project site is located within Section 36, T. 30 S., R. 30 W., Seward Meridian; USGS Quad Map AK-Karluk C-1; Latitude 57.5350º N., Longitude 154.0218º W.; approximately 1 mile southwest of Larsen Bay Harbor along the shore, near Larsen Bay, Alaska. PROPOSED WORK: Expand a current 1-acre aquaculture farm to 198-acre. The aquaculture farm would be 5,400-foot long by 1600-foot wide consisting of fifty (50) submerged long lines 4,800-foot long spaced 20-foot apart. The long lines would be anchored in place with twenty-eight (28) 200-lbs Danforth anchors attached to six (6) A-4 buoy’s by 300-foot anchor lines, and twelve-hundred (1200) cork/weight line combinations, below the Mean High Water Mark (MHWM, 12.82 feet above mean lower low water elevation of 0 feet) of Larsen Bay which is a navigable water of the U.S. If necessary the applicant would place thirty-three (33) 1000-lbs crab pots along the ocean floor to assist in stabilizing the long lines. The crab pots would have all webbing and mesh removed. Access and work on the site would be conducted by a work skiff with no additional support structures on site. The proposed project would encompass roughly 10% of the total area of Larsen Bay. All work would be performed in accordance with the enclosed plan (sheets 1-15), dated April 11, 2017.     Expiration date: 5/10/2017

    Ms. Blanca Hernandez stated the purpose is to provide residential parking and a trail to the adjacent parcel. The project site is located within Section 6, T. 56 S., R. 64 E., Copper River Meridian; USGS Quad Map AK-Sitka A-4; Latitude 57.04658º N., Longitude 135.29193º W.; at 1618 Sawmill Creek Road, Sitka, Alaska. PROPOSED WORK: The applicant proposes to dredge up to 12 cubic yards of native substrate from below the mean high water mark (MHWM, +9.1 feet above mean lower low water) of Jamestown Bay and to discharge 40 cubic yards (CY) of precast block, 80 CY of two inch drain rock, and 700 CY of graded sand, gravel and shot rock up to 12 inches in diameter, including the 12 CY of dredged material, into an 0.03 acre area below the high tide line (HTL, +12.7 feet above mean lower low water) of Jamestown Bay, which is a navigable water of the U.S., for the purpose of creating uplands for residential parking. Work is scheduled to begin the week of July 10, 2017, and would take approximately two weeks to complete.   • POA-2012-863, Beaver Creek

    Expiration date: 4/27/2017

    Drew von Lindern'S (Alaska Department of Transportation and Public Facilities)stated purpose is to extend the service life of the road, enhance transportation capacity, and enhance the overall safety of the KSH in Kenai, AK. The project site is located within Sections 35 & 36, T. 6 N., R. 11 W., Section 31, T. 6 N., R. 10 W., Section 6, T. 5 N., R. 10 W., Seward Meridian; USGS Quad Map Kenai C-3; Latitude 60.5596º N., Longitude 151.1391º W.; Kenai Spur Highway (KSH) mile post 5.15 to milepost 8.1, in Kenai, Alaska. PROPOSED WORK: The applicant proposes to discharge 13,486 cubic yards (cy) of clean fill and aggregate cement (A/C) into 2.54 acres of wetlands for the widening of the existing road footprint and embankment of the Kenai Spur Highway, milepost 5.1 to 8.1. Additionally, the applicant proposes to discharge of 2095 cy of clean fill and A/C into 0.232 acres below the ordinary high water mark of Beaver Creek and an unnamed creek for widening of the existing road embankment, culvert replacement, and bank stabilization at the proposed culvert entrance and exit locations.     Expiration date: 3/22/2017

    Mr. Raleigh Cook stated the purpose is the construction of a new residence. The project site is located within Section 14, T. 60 S., R. 79 E., Copper River Meridian; USGS Quad Map Petersburg C-3; Latitude 56.6678º N., Longitude 132.9147º W.; near 11.7 of the Mitkoff Highway, in Petersburg, Alaska. PROPOSED WORK: Up to 960 cubic yards (CY) of fill material would be discharge into 0.1289-acre of waters of the U.S., including wetlands for the construction of a new residence. An 80-foot by 100-foot area of the property would be cleared of trees, stumps, and brush. A portion of this would be excavated to create a level area for a home and workshop. A 10-foot tall by 120-foot long riprap wall would be constructed at the mean high water line (+15 feet). Up to 150 CY of riprap would be used to construct the wall. Behind the wall would be filled with up to 750 CY of excavated material, which would construct both a yard and drain field for the residence’s septic system. A 500-foot long by 4-foot wide trail would be constructed from the property line to the residence and would require up to 50 CY of 3-inch minus rock over Typar. All work would be performed in accordance with the enclosed plan (sheets 1-4), dated March 6, 2017.   • POA-2016-433, Coffee Creek, APMA 9067

    Expiration date: 4/20/2017

    PURPOSE: Aurquest Alaska Incorporated's stated purpose is to produce commercial quantities of precious metals from two locations on private lands. Also extend stream diversion from 1,500 feet to a total length of 2,200 feet. PROPOSED WORK: The applicant proposes to discharge approximately 26,130 cubic yards (cy) of material into approximately 1.9 acres of wetlands and stream riparian areas as part of a 8.9 acre mining operation. The proposed work would recover precious metals from shallow alluvial deposits at two locations by reworking old mine tailings and areas that have been previously disturbed by earlier mining activities. Place two smaller excavations in previously disturbed, but unmined locations along the south bank (right-limit) to collect and process large bulk samples. Excavate smaller trenches or drill small diameter holes at ten locations to explore and prospect for additional alluvial precious metal deposits. Construct a stream bypass approximately 2,200 feet long along the north bank of Coffee Creek to protect the stream from mining activities related to reprocessing old mine tailings on the valley floor. Conduct reclamation of the valley floor, bulk sample pits, and prospecting sites after applicant's mining activities are completed. All work would be performed in accordance with the enclosed plan (sheets 1-18), dated January 24, 2017. ADDITIONAL INFORMATION: Historical Information: The valley floor of Coffee Creek was extensively mined by mechanical methods in the period preceding WW2 and at various times after the war. Proposed new mining will take place in areas that have been previously mined or prospected by the earlier miners and prospectors. Exploration with small trenches or drill holes will take place in areas that have yet to be prospected in advance of larger excavations. Previous to 2016 construction, Coffee Creek flowed through a sparsely vegetated floodplain of old mine tailings in a channel from 3 to 12 feet wide and from several inches to 12 inches deep.
