Permit Application Public Notices

Public involvement is a key element of the Corps’ permit review process. During an application review, the USACE, Regulatory Division considers the views of other federal, state and local agencies, Native American tribes, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the United States. This is accomplished through the posting of a Public Notice on the USACE, Regulatory Division's website and soliciting comments.

The USACE, Regulatory Division publishes monthly a list of individual permits issued, denied, or pending during the previous month. The list will identify each action by public notice number, name of applicant, and brief description of activity involved. It will also note the relevant environmental documents and the Statements of Findings (SOF) or Records of Decision (ROD) that are available upon written request through the FOIA process and, where applicable, upon the payment of administrative fees.

Special Public Notices

These are public notices that involve the Regulatory program but which are generally not limited to one particular project. These would include public notices for the establishment or modification of Restricted Areas/Danger Zones, issuance/re-issuance of General Permits (Regional General Permits or Nationwide Permits), changes to guidance and policies, etc.

    Mark L. Taylor'S (Pacific & Arctic Railway & Navigation Co) stated purpose is: “The new Boulder Siding is an essential element to the implementation of a new passenger train operating plan the [Pacific & Arctic Railway & Navigation Co.] PARN is implementing to significantly increase the safety to excursion train passengers, its train operating employees, reduce locomotive fuel consumption and will improve passenger train movement efficiency. PROPOSED WORK: The applicant request authorization to discharge 15,000 cubic yards of gravel and 3,000 cubic yards of riprap fill material into 0.75 acres below the ordinary high water mark of the Skagway River, which is a perennial water of the United States, in order to widen 3,200 linear feet of the existing railroad embankment for the construction of a new siding track. The project site is located within Sections 29, 30, and 31, T. 27 S., R. 60 E., Copper River Meridian; USGS Quad Maps Skagway B-1 and Skagway C-1; Beginning at Latitude 59.4854º N., Longitude 135.2753º W. and Ending at Latitude 59.50º N., Longitude 135.2481º W.; within the Pacific & Arctic Railway and Navigation Company main track between Mile 3.7 and Mile 5.1; in Skagway, Alaska.     Ms. Leona Haffner stated purpose is to provide an area to moor small boats, which are used for commercial activities associated with the businesses that lease from the Saxman Seaport. The harbor would also continue to accommodate recreational boaters and residents of the adjacent Pennock Island which use Saxman to transit daily to and from home in Ketchikan. The project site is located within Section 33, T. 76 S., R. 91 E., Copper River Meridian; USGS Quad Map Ketchikan B-5; Latitude 55.3148º N., Longitude 131.5954º W.; in Saxman, Alaska. PROPOSED WORK: The proposed work consists of the deconstruction of the existing barge facility, including a 19 foot by 125 foot transfer bridge and five multi-pile fender dolphins. New facilities would be constructed, including a new concrete planked launch ramp and new small boat floats. All work would be performed in accordance with the enclosed plan (sheets 1-6), dated February 2, 2017.     Mr. Harry Colborn (Mackinaw Productions, LLC) stated purpose is placer mining for gold extraction. The project site is located within Section 11, T. 70 S., R. 112 W., Seward Meridian; USGS Quad Map Unimak A-6; Latitude 54.133305º N., Longitude 165.780875º W.; ATS 1514; 1 Salmon Lane, in Akutan, Alaska. PROPOSED WORK: The applicant proposes to use an excavator to permanently relocate a sinuous 3,220 foot section of Walker Fork Creek. The Walker Fork channel would be moved to the north side of the valley and shortened to 1,870 feet. After relocating the creek, the applicant proposes to “…strip brush, trees and top soils to open up an area for a floater wash plant. That work would be done with a D-10 and a D-8 Cat dozer. Then the gravels would be stripped down as far as possible to the frozen ground.” The plan is to strip three cuts, totaling 57 acres.     Aaron DeSalvo (Trident Seafoods Corporation) stated purpose is to provide an extension of the existing container storage yard and adequate space for a new seafood processing building. The project site is located within Section 11, T. 70 S., R. 112 W., Seward Meridian; USGS Quad Map Unimak A-6; Latitude 54.133305º N., Longitude 165.780875º W.; ATS 1514; 1 Salmon Lane, in Akutan, Alaska. PROPOSED WORK: The application request authorization to discharge 80,000 cubic yards of clean shot rock and riprap fill material into 2.44 acres below the high tide line (approximate elevation +4.7 feet above the 0.0 foot contour) in Akutan Harbor which is a navigable water of the United States for the construction of a new seafood processing building and expansion of an existing container storage yard.     Ms. Renee Huntman (Halliburton Energy Services, Inc.) stated the overall project purpose is to maintain safe traffic patterns and adequate storage for equipment on the Halliburton Energy Services, Inc. (HES) gravel pad north of Deadhorse, providing support to their ongoing oil and gas operations on the North Slope. The project site is located within Section 18, T. 10 N., R. 15 E., on USGS Quad Map AK-BEECHEY POINT A-3; Umiat Meridian; Latitude 70.22773°N, Longitude -148.41326°W, Spine Road, ADL Lease #47660, Deadhorse, Alaska. PROPOSED WORK: The proposed work is to expand the current HES gravel pad by 5.35-acres. Approximately 52,000 cubic yards of clean fill material would be placed in wetlands abutting the north side of the existing HES pad and to east of an existing pipeline. The gravel pad expansion would be constructed so it is level with the existing pad, 5 feet thick. According to Halliburton, the gravel will provide area for parking 30 pieces of additional oilfield equipment (20,000 square feet), palletized storage area for bulk proppant (10,000 square feet), area for function testing equipment (2,000 square feet) and storage of snow in the winter. The work would impact a total of approximately 5.35 acres of tundra wetlands that would be filled. According to the applicant, the wetlands to be filled are primarily of high to moderate value, “Category II” wetlands. The affected acres are Cowardin Classes PUBH, PEM1E, and PEM1F. Their HGM Classes are Riverine, Depressional, and Flat. Gravel would be transported by large dump trucks and placed, leveled, and compacted with dozers, loaders, graders, and a vibrating rolling compactor.
